ORDER OF THE PRESIDENT OF THE COURT

In Case C-656/11 R,
APPLICATION for suspension of operation pursuant to Articles 278 TFEU and 279 TFEU, brought on 21 December 2011 (fax of 16 December 2011),
United Kingdom of Great Britain and Northern Ireland, represented by C. Murrell, acting as Agent, and by A. Dashwood QC,
applicant,
v
Council of the European Union, represented by G. Marhic and M. Veiga, acting as Agents,
defendant,
THE PRESIDENT OF THE COURT,
after hearing the First Advocate General, J. Mazák,
makes the following
Order
1 By application lodged at the Registry of the Court on 16 January 2012 (email of the same day), the European Commission, represented by V. Kreuschitz and S. Pardo Quintillán, acting as Agents, with an address for service in Luxembourg, requested leave to intervene in Case C-656/11 R in support of the form of order sought by the Council.
2 The application to intervene was made in accordance with Article 93(1) of the Rules of Procedure, and is submitted pursuant to the first paragraph of Article 40 of the Statute of the Court of Justice of the European Union.
On those grounds, the President of the Court hereby orders:
1. The European Commission is granted leave to intervene in Case C-656/11 R in support of the form of order sought by the Council of the European Union.
2. A period shall be prescribed within which the intervener is to state in writing the pleas in law in support of the form of order which it seeks.
3. The Registrar shall ensure that copies of all the procedural documents are served on the intervener.
4. The costs are reserved.
