ORDER OF THE PRESIDENT
OF THE SEVENTH CHAMBER OF THE GENERAL COURT

(Removal from the register)

In Case T‑99/17,

Eutelsat SA, established in Paris (France), represented by L. de la Brosse, lawyer,

applicant,

v

European GNSS Agency (GSA), represented by E. Villa and D. Petrlík, acting as Agents, and by C. Kennedy-Loest, Solicitor and C. Thomas, lawyer,

defendant,

APPLICATION under Article 263 TFEU seeking the annulment of the decision of the GSA of 29 November 2016 rejecting the tender submitted by the applicant in procurement procedure ‘GSA/CD/14/14 – Galileo Service Operator’ and the decision awarding that contract to another tenderer.


 

1        By letter lodged at the Court Registry on 16 September 2019, the applicant informed the Court, in accordance with Article 125 of the Rules of Procedure of the General Court, that it wished to discontinue proceedings. It sought no order as to costs.

2        By letter lodged at the Court Registry on 27 September 2019, the defendant informed the Court that it does not object to the discontinuance of these proceedings and the removal of the case from the register. It sought no order as to costs.

3        Article 136(4) of the Rules of Procedure provides that, where proceedings are discontinued, if costs are not claimed, the parties are to bear their own costs.

4        The case shall therefore be removed from the register and, in the absence of any claim in that regard, the parties ordered to bear their own costs.

On those grounds,

THE PRESIDENT OF THE SEVENTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T99/17 is removed from the register of the General Court.

2.      Each party shall bear its own costs.
