An easement granted in a 1938 conveyance was conditional upon the future construction of a road; it was therefore void for perpetuity. In case that was wrong, the judge also held that the applicants who sought the registration had acquieseced in the respondents' cultivation of the relevant land as part of their garden so that it would be unconscionable from them now to assert that there was an easement.
