A claim by the trustees of an allotment association for first registration of a plot adjoining the allotments, based on adverse possession. Factual possession was not established on the evidence. Had possession been established then possession would have accrued for the benefit of the landlord from whom the trustees leased the allotments. The presumption that the tenant took possession for the benefit of the landlord was not rebutted â€-œ Tower Hamlets LBC v. Bartlett [2005] EWCA Civ 923 considered.
