Vendor instructed solicitors to act on a sale, thought the sale had gone off and expressed surprise when the net proceeds of sale were paid into her Barclays bank account in accordance with an authority she had signed. Shortly after completion, when notified of an application to register the TR1, the vendor claimed that she did not sign the TR1 and that the net proceeds of sale had been unlawfully withdrawn from her bank account by her solicitor. A complaint was made to SRA, about six months after completion, which investigated and concluded no action was to be taken. No complaint or report was made to the police. The vendor asserted that a complaint was made to Barclays which investigated but she failed to give any disclosure about that. The vendor who now lives in Ghana did not attend the hearing. A very late application for a postponement was refused. Case heard in the absence of the respondent vendor. The credible evidence that the vendor did sign the TR1 was overwhelming and Respondent vendor's case was rejected.
