Disputed boundary left open by the original vendor and purchaser but their agreement as to where it should be recorded in writing shortly after the purchase. Following the sale of one plot, the owner of the remaining plot applied for a determined boundary, relying on the written agreement, an exchange between solicitors on the onward sale and the marking of the plot with markers (subsequently driven into the ground). The Respondent objected to the boundary agreement on the grounds that it had not been acted upon, and upon the fact that the markers could not now be found. Application given effect to.
