1. In
light of the judgment which I have delivered today in the case between The
Minister for Education and Science and the Information Commissioner, I am
satisfied that the issues which arise in these proceedings have been determined
in those other proceedings. In these proceedings the Minister sought
declarations in relation to the provisions of Section 53 of the Education Act
of 1998 and its relationship to the provision of the Freedom of Information Act
of 1997. In light of my ruling in the case of The Minister for Education and
Science -v- The Information Commissioner I do not consider it necessary for me
to make any order in these proceedings.
