UNEMPLOYMENT INSURANCE.


MERCANTILE MARINE (COLLECTION OF CONTRIBUTIONS).

The Unemployment Insurance (Mercantile Marine) (Collection of Contributions) (Amendment) Regulation, 1926, dated 9th January, 1926, made by the Minister for Industry and Commerce under the Unemployment Insurance Acts, 1920 to 1924.

WHEREAS it is desirable to amend the Unemployment Insurance (Mercantile Marine) (Collection of Contributions) Regulations, 1921 (hereinafter referred to as " the Regulations of 1921 "):

NOW, THEREFORE, the Minister for Industry and Commerce (hereinafter referred to as " the Minister, ") in exercise and by virtue of the powers conferred on him by the Unemployment Insurance Acts, 1920 to 1924, and of all other powers enabling him in that behalf, hereby makes the following Regulation for amending the Regulations of 1921 :—

1. Part IV of the Regulations of 1921 shall cease to have effect, and the following provisions shall have effect in lieu thereof :

(1) Where contributions (hereinafter referred to as " the aforesaid contributions "), are payable in respect of any person excluded from the Unemployment Insurance Acts, 1920 to 1924, by the Special Order dated 29th January, 1921, made under Section 39 (a) of the Unemployment Insurance Act, 1920, the managing owner, or where there is no managing owner, the person to whom the management of the ship is entrusted by or on behalf of the owner (hereinafter called " the manager,") shall, subject as hereinafter provided within three months from the expiration of every half year ending 30th June and 31st December send to the Minister a return showing, in respect of such ship for the whole period of any voyage or voyages terminating in the half year to which the return relates, the number of persons so employed in the ship in respect of whom the aforesaid contributions are payable, and the total amount of the contributions so payable.

For the purposes of this Regulation, the voyage of a ship to which sub-section (4) of Section 116 of the merchant Shipping Act, 1894, applies shall be deemed to terminate as at the date of the termination of the agreement with the crew thereof in accordance with the provisions of the said sub-section.

(2) The amount of the contributions payable in respect of the persons comprised in the return shall be paid to the Minister at the time at which the return is made.

(3) Where no person in respect of whom the aforesaid contributions are payable has been employed on a ship, or where the ship has not completed a voyage, during the half year, the managing owner or manager of the ship shall write on the return a statement to that effect, and shall send the return to the Minister within the time prescribed by this Regulation for the sending of returns.

Provided that nothing herein contained shall require a return to be sent to the Minister in the case of a ship which either is a ship employed solely in harbours or on short excursions or pleasure trips to sea, or is a tug boat, hulk, dredger, or steam hopper, and on which there is not employed any person in respect of whom the aforesaid contributions are payable.

(4) The return required by this Regulation shall be in the form set out in the schedule hereto attached.

2. This Regulation may be cited as the Unemployment Insurance (Mercantile Marine) (Collection of Contributions) (Amendment) Regulation, 1926, and the Regulations of 1921, and this Regulation may be cited together as the Unemployment Insurance (Mercantile Marine) (Collection of Contributions) Regulations, 1921 and 1926.

SCHEDULE.

Half-yearly Return of Contributions payable by (Insert name and address of owner) in respect of any master, seaman, or apprentice who is neither domiciled nor has a place of residence in Saorstát Eireann, and any master, seaman, or apprentice who has neither been domiciled nor had a place of residence in Saorstát Eireann since the sixth day of December, 1922, serving in a ship registered in Saorstát Eireann, or in a British ship or vessel (not being a ship registered in Great Britain or Northern Ireland), of which the owner, or if there is more than one owner, the managing owner or manager resides or has his principal place of business is Saorstát Eireann.
