BY-LAW No. 389 No. 3 or WATERFORD DISTRICT

RIVER SUIR


I, FIONÁN O LOÍNGSIGH, Minister for Lands and Fisheries, by virtue and in exercise of the powers vested in me by the Fisheries Act, 1925 , and of every other power enabling me in this behalf, do MAKE AND ORDAIN THE FOLLOWING BY-LAW :—

(1) It is prohibited to use any net for the purpose of taking or with intent to take fish, save landing nets used solely as auxiliary to fishing legally with rod and line and nets used for the capture of eels, in that part of the River Suir and its tributaries in the No. 3 or Waterford District which is situated above or upstream of the bridges at Suir Island in the town of Clonmel.

(2) It is prohibited to put, leave, or have in possession in or on the banks of the said part of the river and its tributaries, or in any boat thereon, any net of which the use would not be lawful at the time.

(3) Each and every person offending against this By-law shall forfeit and pay for each offence a sum not exceeding five pounds ; and every net used or found contrary to this By-law shall be forfeited.

(4) The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this By-law in like manner as it applies to the interpretation of an Act of the Oireachtas.

(5) This By-law may be cited for all purposes as the River Suir By-law, No. 389, 1928.

NOTE.—Under the provisions of the Fisheries Act, 1925 , this By-law will come into operation on the twenty-eighth day after the above date.
