BY-LAW No. 404 No. 8 or LIMERICK DISTRICT

RIVER FEALE


I, FIONÁN O LOÍNGSIGH, Minister for Lands and Fisheries, by virtue and in exercise of the powers vested in me by the Fisheries Act, 1925 , and of every other power enabling me in this behalf, do MAKE AND ORDAIN THE FOLLOWING BY-LAW :—

(1) It is prohibited to catch or attempt to catch fish between the hours of six o'clock on Saturday evening and twelve o'clock noon on the following Monday, or at any other time when the mill is not working, in the mill stream near Listowel flowing through the townlands of Islandganniv North and Gortcurreen, in the parish of Listowel, Kilcreen and Garryantanvally in the parish of Finuge, and Scartleigh in the parish of Dysert, all in the County of Kerry.

(2) It is prohibited to catch or attempt to catch fish at any time in the parts of the said mill stream extending from the mill and the waste sluice above the mill to the boundary between the townlands of Islandganniv North and Gortcurreen aforesaid.

(3) It is prohibited to put, leave, or have in possession in or on or near the banks of the said mill stream at any time when its use would not be lawful, any rod, net, or other instrument for catching fish, or capable of being used for catching fish.

(4) Each and every person offending against this By-Law shall forfeit and pay for each offence a sum not exceeding five pounds ; and every rod, net, or other instrument used or found contrary to this By-Law shall be forfeited.

(5) The Interpretation Act, 1923 , applies to the interpretation of this By-Law in like manner as it applies to the interpretation of an Act of the Oireachtas.

(6) This By-Law may be cited for all purposes as the River Feale By-Law, No. 404, 1930.

NOTE.—Under the provisions of the Fisheries Act, 1925 , this By-Law will come into operation on the twenty-eighth day after the above date.
