VOCATIONAL EDUCATION (GRANTS) REGULATIONS, 1931.

WHEREAS it is enacted by sub-section (1) of section 53 of the Vocational Education Act, 1930 (No. 29 of 1930), that the Minister for Education may, out of moneys provided by the Oireachtas, make grants to vocational education committees in aid of expenditure under annual schemes in accordance with regulations made by the said Minister with the approval of the Minister for Finance :—

NOW, I, JOHN MARCUS O'SULLIVAN, Minister for Education, in exercise of the power conferred on me by section 53 of the Vocational Education Act, 1930 , and of every and any other power me in this behalf enabling and with the approval of the Minister for Finance do hereby make the following regulations :—

1. These Regulations may be cited as the Vocational Education (Grants) Regulations, 1931.

2. In these regulations—

the expression " the Minister " means the Minister for Education,

the expression " the Act " means the Vocational Education Act, 1930 (No. 29 of 1930),

the word " committee " means a vocational education committee,

the word " grant " means a grant made to a committee under section 53 of the Act.

3. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

4. Every grant shall be payable in such instalments at such times as the Minister shall in each particular case think proper.

5. The grant made to any particular committee in the financial year ending on the 31st day of March, 1932, shall (subject to the provisions of these Regulations in relation to the reduction of grants) be of the amount stated in the second column of the Schedule hereto opposite the name of such committee in the first column of the said Schedule.

6. The grant made to any particular committee in the financial year ending on the 31st day of March, 1933, or any subsequent financial year shall (subject to provisions of these Regulations in relation to the reduction of grants) be of such amount as shall be fixed by the Minister with the sanction of the Minister for Finance.

7. If the Minister is of opinion that in the financial year ending on the 31st day of March, 1932 (hereinafter called the present year) any committee has not achieved or has not maintained a proper standard of efficiency in the discharge of its functions relating to continuation and technical education, the Minister may ascertain the amount of the sum which such committee would have received in the present year by way of grant under the Programme for Technical Schools and Classes issued by the Department of Education if grants were paid under that Programme in the present year and, if such sum is less than the sum which was paid by way of grant under the said Programme in the financial year ending on the 31st day of March, 1930, to the predecessor of such committee in respect of the area coterminous with or corresponding to the vocational education area of such committee, the Minister may reduce the grant to such committee in the present year by such amount, not exceeding the difference between such sums as the Minister shall think proper.

8. Whenever in any financial year a committee in the opinion of the Minister—

(a) has failed to achieve or to maintain a reasonable standard of efficiency in the discharge of its functions, or

(b) has failed to perform its duties or any one or more of its duties under the Act, or

(c) has failed to supply punctually to the Minister any information or return which such committee was required under the Act so to furnish,

the Minister may, in addition and without prejudice to any other reduction under these Regulations, reduce the grant to such committee in such year by such amount as he shall think proper.

9. If the Minister is satisfied that by reason of special expenditure reasonably and properly incurred or any other special circumstances a committee requires a special addition to its funds in the financial year ending on the 31st day of March, 1932, the Minister may, with the consent of the Minister for Finance, make to such committee in that year a special additional grant of such amount as the Minister with the consent aforesaid shall think proper, but the total amount of the grants made under this paragraph shall not exceed the sum of £2,156 (two thousand one hundred and fifty-six pounds).
