LOUGH ENNELL | ||
I, FIONÁN Ó LOINGSIGH, Minister for Lands and Fisheries, by virtue and in exercise of the powers vested in me by the Fisheries Act, 1925 , and of every other power enabling me in this behalf, DO MAKE AND ORDAIN THE FOLLOWING BY-LAW :— | ||
(1) It is prohibited to use any net for the purpose of taking or with intent to take fish in Lough Ennell, in the County of Westmeath, save only between the hours of 10 a.m. and 7 p.m. during the period from the 1st July to the 31st August in each year, both said days inclusive. | ||
(2) It is prohibited to use in the said Lough Ennell at any time any net having a mesh less than 2¼ inches from knot to knot or 9 inches in the round measured in the clear when the net is wet, or any net mounted with a foot-rope or exceeding 75 yards in length measured along the head-rope. | ||
(3) No net shall be shot or used in the said Lough Ennell at a distance of less than 25 yards from another net which is already fishing. | ||
(4) It is prohibited to put, leave or have in possession in or on the banks of the said Lough Ennell any net, mounted and capable of being used for fishing, but this shall not apply to a net of lawful mesh, length or construction between the hours of 9 a.m. and 8 p.m. during the aforesaid period from the 1st July to the 31st August. | ||
(5) This By-law shall not apply to landing nets used as auxiliary to lawful angling with rod and line or drum nets used for the capture of fish other than salmon or trout. | ||
(6) The provisions relating to Lough Ennell in the Loughs Ennell and Derravaragh By-law No. 387, 1928, are hereby revoked. | ||
(7) Each and every person offending against this By-law shall forfeit and pay for each offence a sum not exceeding £5, and every net used or found contrary to this By-law shall be forfeited. | ||
(8) The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of this By-law in like manner as it applies to the interpretation of an Act of the Oireachtas. | ||
(9) This By-law may be cited for all purposes as the Lough Ennell By-law No. 412, 1931. | ||
