FOOT AND MOUTH DISEASE (IMPORTATION OF RODENTS AND INSECTIVORA) ORDER, 1933.

ORDER OF THE MINISTER FOR AGRICULTURE.

(Dated 31st January, 1933.)

The Minister for Agriculture, by virtue and in exercise of the powers vested in him by the joint operation of the Agriculture Act, 1931 (No. 8 of 1931), and the Diseases of Animals (Ireland) Acts, 1894 to 1932, and of every and any other power him in this behalf enabling doth hereby order as follows :—

1. This Order may be cited for all purposes as the Foot and Mouth Disease (Importation of Rodents and Insectivora) Order, 1933.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In this order—

the expression "the Act of 1894" means the Diseases of Animals Act, 1894,

the expression "the Minister" means the Minister for Agriculture,

the expression "master" includes a person having the charge or command of a vessel,

the word "animals" means hedgehogs, moles, shrews, squirrels, marmots, prairie dogs, beavers, rats, mice, voles, lemmings, jerboas, porcupines, agoutis, guinea pigs, South American capybara, hares and rabbits.

4. (1) It shall not be lawful to import into Saorstát Eireann from any country any animal unless such animal is imported under and in accordance with a permit in that behalf obtained from the Minister.

(2) If any animal is imported in contravention of this Article, the owner and the charterer and the master of the vessel from which such animal is landed, and the person for the time being in charge of such animal, and the person causing, directing or permitting such landing, and the person landing such animal, and the consignee or other person receiving or keeping such animal knowing it to have been so imported, shall, each according to and in respect of his own acts and defaults, be deemed guilty of an offence against the Act of 1894.

5. (1) If any animal is imported in contravention of the immediately preceding article, the Minister or an Inspector of the Minister may give notice to the owner or person in charge of such animal requiring such animal, so long as such notice is in force, to be detained and isolated in accordance with the provisions of such notice.

(2) If any owner or person to whom notice has been given under the immediately preceding paragraph fails to comply with such notice, he shall be deemed guilty of an offence against the Act of 1894.

(3) A notice under paragraph (1) of this Article shall continue in force unless and until it is withdrawn by the Minister or an Inspector of the Minister.
