NATIONAL HEALTH INSURANCE.

(REMOVAL OF DIFFICULTIES) ORDER, 1933.

(REMOVAL OF DIFFICULTIES) ORDER, 1933.

NATIONAL HEALTH INSURANCE (REMOVAL OF DIFFICULTIES) ORDER, 1933, DATED 20TH DECEMBER, 1933, MADE BY THE MINISTER FOR LOCAL GOVERNMENT AND PUBLIC HEALTH UNDER SECTION 29 of THE NATIONAL HEALTH INSURANCE ACT, 1933 .

WHEREAS by Section 3 of the National Health Insurance Act, 1933 (in this Order called "the Act") it is amongst other things enacted that a Society styled Cumann an Árachais Náisiúnta ar Shláinte hereinafter referred to as "the Unified Society," shall be established for the purpose of transacting health insurance business in respect of all insured persons resident in Saorstát Eireann:

AND WHEREAS by Section 14 of the Act it is enacted that the provisional committee of the Unified Society appointed by the Minister shall, with the approval of the Minister for Local Government and Public Health, fix in respect of every Approved Society a day to be the day of transfer:

AND WHEREAS by Section 15 of the Act it is enacted that on the day of transfer fixed in respect of an Approved Society, such Approved Society shall cease to carry on business and its engagements under the National Health Insurance Acts shall be transferred to the Unified Society, and its insured members shall become members of the Unified Society:

AND WHEREAS under the provisions of Section 29 of the National Health Insurance Act, 1933 , it is provided that if any difficulty arises with respect to the constitution of the Unified Society or otherwise in bringing into operation any of the preceding provisions of the Act, the Minister may, by order made before the appointed day, make any appointment and do anything which appears to him necessary or expedient for bringing the said provisions into operation, and any such order may modify the provisions of this Act so far as may appear necessary or expedient for carrying the order into effect:

AND WHEREAS by Section 8 of the Act it is enacted amongst other things that no employee of the Unified Society shall be a member of the Committee of Management or board of directors of any Society or Company transacting insurance business or be employed as officer, agent or employee of any such Society or Company:

AND WHEREAS certain of the Approved Societies to be transferred are Societies working in conjunction with societies or companies transacting insurance business and availing of the services of employees of such societies or companies for agency work:

AND WHEREAS it is necessary to make available immediately a comprehensive agency system covering the whole of Saorstát Eireann and such agency system can not be established unless existing agents of Approved Societies can be employed temporarily and a difficulty has thereby arisen within the meaning of the said Section 29.

NOW, THEREFORE, I, SEAN T. Ó CEALLAIGH, Minister for Local Government and Public Health, in pursuance of the powers vested in me by Section 29 of the Act, hereby order as follows:—

1. Where it has been the custom of an Approved Society whose engagements have been transferred to the Unified Society, to employ as agents persons in the employment of a society or company transacting insurance business, it shall be lawful for the provisional committee, notwithstanding the provisions of Section 8 of the Act, to continue to employ such persons as agents for a period not exceeding 12 months after the transfer of engagements.

2. This Order may be cited as the National Health Insurance (Removal of Difficulties) Order, 1933.
