No. 109/1934:

POISONS (IRELAND) ACT, 1870 (ADDITIONAL POISON) ORDER 1934.

POISONS (IRELAND) ACT, 1870 (ADDITIONAL POISON) ORDER 1934.

WHEREAS it is enacted by section 1 of The Poisons (Ireland) Act, 1870, that the several articles mentioned in the Schedule A to the said Act shall be deemed to be poisons within the meaning of the said Act, and that the Royal College of Physicians of Ireland (in the said section 1 referred to as the King and Queen's College of Physicians in Ireland) may from time to time, by resolution, declare that any article other than those mentioned in the said Schedule and in such resolution named ought to be deemed a poison within the meaning of the said Act, and thereupon the said College shall submit the said resolution for the approval of Her Majesty's Privy Council in Ireland, and if such approval shall be given, then such resolution and approval shall be advertised in " Iris Oifigiuil," and on the expiration of one month from such advertisement the article named in such resolution shall be deemed to be a poison within the meaning of the said Act:

AND WHEREAS by the Poisons (Ireland) Act, 1870, Adaptation Order, 1933, the said section 1 of the Poisons (Ireland) Act, 1870, was adapted by the substitution therein of the words " Executive Council of Saorstat Eireann " for the words " Her Majesty's Privy Council in Ireland."

AND WHEREAS on the 2nd day of February, 1934, the Royal College of Physicians of Ireland passed the following resolution, that is to say, " That the President and Fellows recommend that in Part II of Schedule A of the Sale of Poisons (Ireland) Act, 1870, the words ` and such of its homologues as do not contain more than nine carbon atoms and all preparations and admixtures of Phenol and such homologues, except tooth pastes, tooth powders and solid soaps for washing ' be added after the word ` Phenol ' where that word occurs in the said Part of the said Schedule " .

NOW, the Executive Council of Saorstat Eireann in exercise of the powers conferred on them by the said section 1 of the Poisons (Ireland) Act, 1870, as so adapted and of every and any other power them in this behalf enabling, do hereby order as follows, that is to say:—

1. The hereinbefore recited resolution dated the 2nd day of February, 1934, of the Royal College of Physicians of Ireland is hereby approved of.

2. This Order may be cited for all purposes as the Poisons (Ireland) Act, 1870 (Additional Poison) Order, 1934.
