DEPARTMENT OF AGRICULTURE.

No. 241/1934:

THE AGRICULTURAL PRODUCE (MAIZE MEAL MIXTURE) NO. 2 REGULATIONS, 1934.

THE AGRICULTURAL PRODUCE (MAIZE MEAL MIXTURE) NO. 2 REGULATIONS, 1934.

WHEREAS it is enacted by sub-section (1) of Section 82 of the Agricultural Produce (Cereals) Act, 1933 (No. 7 of 1933), that it shall not be lawful for any registered maize miller to sell or offer for sale any maize meal mixture unless such maize meal mixture complies with the following specifications, that is to say:—

(a) Oats (if any) included therein is, if an Order under sub-section (3) of the said section is not then in force, in one or other of the following forms, that is to say, the entire product derived from grinding oats or the entire product derived from grinding the kernels only of oats, or, if any such Order is then in force, in the form required by such Order;

(b) the amount by weight of oats (if any) included therein in the form of the entire product derived from grinding oats does not exceed the prescribed percentage of such maize meal mixture;

(c) in case such maize meal mixture does not include any oats or includes any oats in the form of the entire product derived from grinding oats, the amount by weight of the product derived from grinding maize included therein does not exceed the prescribed percentage of such maize meal mixture;

(d) in case such maize meal mixture includes any oats in the form of the entire product derived from grinding the kernels only of oats, the amount by weight of the product derived from grinding maize included therein does not exceed the appropriate prescribed percentage of such maize meal mixture:

AND WHEREAS it is enacted by sub-section (2) of Section 82 of the said Act that the Minister for Agriculture in making regulations in relation to the percentage referred to in paragraph (d) of subsection (1) of the said Section 82 as prescribed shall, by reference to the quantity of oats contained in maize meal mixture to which the said paragraph (d) applies, divide such maize meal mixtures into such and so many classes as he may think proper, and shall prescribe different percentages in respect of different classes, and the percentage so prescribed in respect of any such class shall for the purposes of the said paragraph (d) be the appropriate prescribed percentage in relation to every maize meal mixture which belongs to such class;

AND WHEREAS the Minister for Agriculture is empowered by virtue of Section 78 of the said Act to make by Order regulations in relation to any matter or thing referred to in Section 82 of the said Act as prescribed;

NOW, THEREFORE, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Agricultural Produce (Cereals) Act, 1933 (No. 7 of 1933), and of every and any other power me in this behalf enabling, do hereby Order and make the following Regulations, that is to say: —

1. These Regulations may be cited for all purposes as the Agricultural Produce (Maize Meal Mixture) Regulations, 1933.

2. These Regulations shall come into force on the 24th day of July, 1933.

3. In these Regulations the expression " the Act " means the Agricultural Produce (Cereals) Act, 1933 (No. 7 of 1933).

4. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

5.—(1) For the purposes of paragraph (b) of sub-section (1) of section 82 of the act the prescribed percentage shall be twenty-five per cent.

(2) For the purposes of paragraph (c) of sub-section (1) of section 82 of the act the prescribed percentage shall be seventy-five per cent.

(3) For the purposes of paragraph (d) of sub-section (1) and subsection (2) of section 82 of the act, the following provisions shall have effect, that is to say:

(a) maize meal mixtures which include therein oats in the form of the entire product derived from grinding the kernels only of oats shall be divided into the following classes, that is to say—

(i) Class I, i.e., where amount by weight of oats is less than seventeen per cent. of the weight of the maize meal mixture,

(ii) Class II, i.e., where the amount by weight of oats is seventeen per cent. of the weight of the maize meal mixture,

(b) the prescribed percentage in respect of Class I shall be seventy-five per cent.;

(c) the prescribed percentage in respect of Class II shall be eighty-three per cent.

6. Paragraph 10 of the Agricultural Produce (Cereals) (Wheat Growing and Feeding Stuffs) Regulations, 1933, is hereby revoked.
