AGRICULTURAL PRODUCE (CEREALS) ACT, 1934 (PART IV) REGULATIONS, 1934,

AGRICULTURAL PRODUCE (CEREALS) ACT, 1934 (PART IV) REGULATIONS, 1934,

WHEREAS by virtue of the Agricultural Produce (Cereals) Act, 1934 (Operation of Part IV) Order, 1934 (Statutory Rules and Orders No. 273 of 1934), Part IV of the Agricultural Produce (Cereals) Act, 1934 (No. 41 of 1934), came into operation on the ninth day of October, 1934;

AND WHEREAS the Minister for Agriculture is empowered by the said Part IV to make, by order, regulations in relation to the several matters and things which are the subject of these regulations;

NOW, THEREFORE, I, SEAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by Part IV of the Agricultural Produce (Cereals) Act, 1934 (No. 41 of 1934), and of every and any other power me in this behalf enabling, do hereby order and make the following regulations, that is to say:—

1. These Regulations may be cited for all purposes as the Agricultural Produce Cereals Act, 1934 (Part IV), Regulations, 1934.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In these Regulations —

the expression " the Minister " means the Minister for Agriculture;

the expression " the Act " means the Agricultural Produce (Cereals) Act, 1934 (No. 41 of 1934)

4. For the purposes of paragraph (c) of sub-section (3) of section 42 of the act—

(a) every application for registration in the register of dealers in oats and barley shall be in the Form A.P.C. 19 in the Schedule hereto and shall contain the particulars asked for or otherwise indicated in that form;

(b) every application for registration in the register of oatmeal millers shall be in the Form A.P.C. 20 in the Schedule hereto and shall contain the particulars asked for or otherwise indicated in that Form.

5.—(1) Every registered oat and barley dealer shall within seven days after the expiration of the month of November, 1934, and of every subsequent month in the period during which Part IV of the Act is in force furnish to the Minister a return in the Form A.P.C. 21 in the Schedule hereto giving in respect of such month the particulars indicated in that form.

(2) Every registered oatmeal miller shall within seven days after the expiration of the month of November, 1934, and of every subsequent month in the period during which Part IV of the Act is in force furnish to the Minister a return in the Form A.P.C. 22 in the Schedule hereto giving in respect of such month the particulars indicated in that form.

6. For the purposes of sub-section (1) of section 48 of the Act—

(a) the records required by that section to be kept by every registered oat and barley dealer shall be in the Form A.P.C. 23 in the Schedule hereto, and the particulars to be entered therein shall be those indicated in the said form;

(b) the records required by that section to be kept by every registered oatmeal miller shall be in the Form A.P.C. 24 in the Schedule hereto, and the particulars to be entered therein shall be those indicated in the said form.
