VARIATION OF THE SCALES OF EXPENSES IN RELATION TO DRAFT JURORS' LISTS, 1934.

VARIATION OF THE SCALES OF EXPENSES IN RELATION TO DRAFT JURORS' LISTS, 1934.

WHEREAS the Minister for Justice is required and empowered by Section 15 of the Local Services (Temporary Economies) Act , 1934 (No. 16 of 1934), to make, for and in respect of the preparation of the draft lists of persons qualified on the 15th day of November, 1934, to serve as jurors and liable so to serve, such variation of the scales in force under sub-section (3) of Section 17 of the Juries Act, 1927 (No. 23 of 1927), as will, in his opinion, secure that the sums payable in respect of the preparation of the said draft lists to any person in accordance with such scales will be reduced by such amount as the said Minister shall think proper having regard to the deductions from salaries to be made under the said Local Services (Temporary Economies) Act, 1934 , and the other circumstances of the case:

NOW the Minister for Justice, in pursuance of Section 15 of the Local Services (Temporary Economies) Act, 1934 (No. 16 of 1934), and in exercise of the power thereby conferred on him and of every and any other power him in this behalf enabling, hereby varies, in accordance with the following provisions, the said scales in force under sub-section (3) of Section 17 of the Juries Act, 1927 (No. 23 of 1927):

1. This instrument may be cited as the Variation of the Scales of Expenses in relation to Draft Jurors' Lists, 1934.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this instrument in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. The provisions of this instrument apply only in relation to sums payable under the scales (in this instrument referred to as the existing scales) in force under sub-section (3) of Section 17 of the Juries Act, 1927 (No. 23 of 1927), in respect of the preparation of the draft lists of persons qualified on the 15th day of November, 1934, to serve as jurors and liable so to serve.

4. Sums payable under the existing scales which :—

(a) do not exceed £60, or

(b) are distinguished and paid thereunder as and for actual expenses, or

(c) are required either by statute, contract of service or otherwise to be surrendered by the person receiving the same to the local authority by whom he is employed or to the Exchequer, or

(d) are in respect of cost of printing,

are not subject to variation under this instrument.

5. Subject to the foregoing provisions of this instrument, every sum payable under the existing scales shall be varied as follows:—

(a) where such sum exceeds £60 but does not exceed £120, such sum shall be reduced by an amount equal to a 2½ per cent. of five-sixths of such sum;

(b) where such sum exceeds £120, such sum shall be reduced by an amount equal to £2 10s, plus 5 per cent. of the difference between five-sixths of such sum and £100.
