PIGS AND BACON ACT, 1935 (PART II) (No. 1) REGULATIONS, 1935.

WHEREAS by virtue of the Pigs and Bacon Act, 1935 (Parts I and II) (Commencement) Order, 1935 (Statutory Rules and Orders, No. 187 of 1935) Part II of the Pigs and Bacon Act, 1935 (No. 24 of 1935), came into operation on the 18th day of July, 1935:

AND WHEREAS the provisions of the said Act hereinafter mentioned are contained in Part II thereof:

AND WHEREAS it is enacted by sub-section (1) of Section 8 of the said Act that the Minister for Agriculture may by Order make regulations in relation to any matter referred to in Part II of the said Act as prescribed:

AND WHEREAS these Regulations relate to matters which are referred to in Sections 11, 21 and 24 of the said Act as prescribed:—

NOW THEREFORE, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by Part II of the Pigs and Bacon Act, 1935 (No. 24 of 1935), and of every and any other power me in this behalf enabling, do hereby order and make the following Regulations, that is to say:—

1. These Regulations may be cited as the Pigs and Bacon Act, 1935 (Part II) (No. 1) Regulations, 1935.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In these Regulations:—

the expression " the Act " means the Pigs and Bacon Act, 1935 (No. 24 of 1935);

the expression " The Minister " means the Minister for Agriculture.

4. For the purposes of paragraph (a) of sub-section (4) of section 11 of the act:—

(a) every application for registration in the register of minor curers shall be made to the Minister in the Form P.B. 1 in the First Schedule hereto and shall contain the relevant particulars asked for or otherwise indicated in the said Form; and

(b) every application for registration in the register of pork butchers shall be made to the Minister in the Form P.B. 2 in the First Schedule hereto and shall contain the relevant particulars asked for or otherwise indicated in the said Form.

5. For the purposes of paragraph (a) of sub-section (2) of Section 21 of the Act:—

(a) every application for a curing licence shall be in the Form P.B. 3 in the First Schedule hereto and shall contain the relevant particulars asked for or otherwise indicated in the said Form, and

(b) every application for a curing and slaughtering licence shall be in the Form P.B. 4 in the First Schedule hereto and shall contain the relevant particulars asked for or otherwise indicated in the said Form.

6. For the purposes of paragraph (d) of sub-section (8) of Section 24 of the Act, the prescribed plant and equipment shall be the plant and equipment specified in the Second Schedule hereto.

SECOND SCHEDULE.


PLANT AND EQUIPMENT OF CURING AND SLAUGHTERING PREMISES.


1. Proper facilities shall be available for hoisting pigs and/or carcases by means of a power windlass, elevator or other suitable device.

2. Suitable receptacles shall be provided for the collection and removal of blood, refuse, waste, and unsound, rejected or condemned materials as well as all articles unfit for human consumption.

3. Suitable receptacles, containers and means of conveyance shall be provided for offals, carcases, parts of carcases, trimmings, etc., gambrels, hooks, and other articles of equipment.

4. A suitable and adequate overhead rail system shall be provided.

5. A suitable table or bench or such other equipment as is necessary shall be provided for the proper cleaning, dressing and preparation of offals.

6. Suitable tables or benches and other necessary facilities shall be provided for:—

(a) the examination of offals at the time of removal from carcases;

(b) the examination of carcases;

(c) the examination of bacon; and

(d) the carrying out of such supervision, inspection and examination as may be necessary in accordance with the provisions of the Act.

7. Suitable provision shall be made for the detention of such offals, carcases and bacon, as may become necessary in the carrying out of duties by the veterinary examiner. Such provision shall include separate overhead hanging rail accommodation, suitably placed and reserved solely for such materials and for use in such manner as the veterinary examiner may decide.

8. Suitable lock-up office accommodation shall be provided in a convenient situation for the exclusive use of the veterinary examiner. Such office accommodation shall be fitted with suitable lockers and adequate facilities for washing. Suitable facilities shall also be provided for the sterilisation of the veterinary examiner's instruments and other equipment.

9. A bleeding-passage shall be provided, constructed of concrete or other non-absorbent material capable of being readily cleansed, and with sloped and channelled floor and effective drainage. The bleeding passage shall be fitted with an overhead bleeding rail, at a height sufficient to prevent any portion of a carcase coming into contact with the floor of the passage, and shall be of a length commensurate with the maximum rate of work in the premises and sufficient to ensure adequate bleeding.

10. Suitable scalding facilities commensurate with the volume of work and the rate of slaughter shall be provided.

11. A dehairing machine shall be provided in every case where the work of veterinary examination would be unduly prolonged by a slow rate of work in hand scraping and dehairing.

12. In premises where singeing is done the apparatus used shall be of suitable type and suitably situated.

13. Suitable and adequate plant and equipment shall be provided, as required, for the detention and treatment of waste, refuse, unsound articles and all articles unfit or not intended for human food.

14. Suitable equipment shall be provided for the weighing of carcases.
