UNEMPLOYMENT ASSISTANCE (SECOND EMPLOYMENT PERIOD) ORDER, 1935.

THE UNEMPLOYMENT ASSISTANCE (SECOND EMPLOYMENT PERIOD) ORDER, 1935, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE ON THE 29th DAY OF JUNE, 1935, PURSUANT TO SUB-SECTION (3) OF SECTION 4 AND SUB-SECTION (1) OF SECTION 7 of THE UNEMPLOYMENT ASSISTANCE ACT, 1933 .

WHEREAS it is enacted by sub-section (3) of Section 4 of the Unemployment Assistance Act, 1933 , that the Minister for Industry and Commerce may by regulations made by him under that Act prescribe, either generally or in respect of any particular class or classes of persons or any particular district or districts, any period to be an employment period and accordingly no person of such class or resident in such district shall during such employment period b regarded as unemployed within the meaning of that Act :

AND WHEREAS it is enacted by sub-section (1) of Section 7 of the said Act that the Minister for Industry and Commerce may by order make regulations prescribing any matter or thing which is referred to in the said Act as prescribed or to be prescribed or any matter or thing which is expressly authorised by the said Act to be prescribed by regulations made by the Minister under the said Act :

NOW THEREFORE the Minister for Industry and Commerce in exercise of the powers conferred on him by sub-section (3) of Section 4 and sub-section (1) of Section 7 of the Unemployment Assistance Act, 1933 , and of every and any other power him in this behalf enabling, hereby orders as follows, that is to say—

1. This Order may be cited for all purposes as the Unemployment Assistance (Second Employment Period) Order, 1935.

2. The Interpretation Act, 1923 , applies to the interpretation of this order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. The following regulations shall have effect for the purposes of sub-section (3) of Section 4 of the Unemployment Assistance Act, 1933 , that is to say—

I. The expression "dependant" means a dependant within the meaning of Section 5 of the Unemployment Assistance Act, 1933 , or within the meaning of any section of any subsequent enactment which amends or repeals the said Section 5 of the said Act.

II. The period commencing on the 17th day of July, 1935, and ending on the 1st day of October, 1935, shall be an employment period in respect of the following particular classes of persons, namely—

(i) Any occupier of land entered as such in the valuation list within the meaning of the Valuation Acts—

(a) which is not situate within the boundary of any county or other borough or of any urban district or of any town having commissioners under the Towns Improvement Act, 1854 ; and

(b) of which the annual rateable value under the Valuation Acts or the aggregate of such annual rateable values exceeds four pounds.

(ii) Any unmarried man or widower

(a) who has no dependants and

(b) whose place of residence is not situate within the boundary of any county or other borough or of any urban district or of any town having commissioners under the Towns Improvement Act, 1854.

III. For the purposes of these regulations, a person who lets land for depasturage for a period of less than one year shall be deemed to be the occupier of the land so let.
