HALL-MARKING OF IMPORTED PLATE ORDER, 1935.


WHEREAS it is enacted by sub-section (1) of Section 1 of the Hall-marking of Foreign Plate Act, 1904, as adapted by or under the Adaptation of Enactments Act, 1922 (No. 2 of 1922), that where, for the purpose of complying with Sections 59 and 60 of the Customs Act, 1842, or Section 10 of the Revenue Act, 1883, any plate has to be assayed, stamped and marked, or where, for any other purpose, any plate or article imported from a foreign part is brought to an assay office in Saorstát Eireann to be assayed, stamped or marked, the plate or article shall be marked in such manner as the Governor General of the Irish Free State upon the advice of the Executive Council of the Irish Free State may determine so as readily to distinguish whether the plate or other article was wrought or made in Saorstát Eireann, or was imported from a place outside Saorstát Eireann, and such mark or marks shall be deemed to be a compliance with the said Customs Act, 1842, and the said Revenue Act, 1883:

AND WHEREAS it is enacted by sub-section (2) of the said Section 1, as so adapted, that any person (other than a customs officer in certain circumstances) who, after a date to be fixed by order of the Governor-General of the Irish Free State upon the advice of the Executive Council of the Irish Free State, brings or causes to be brought any plate or other article to be assayed, stamped and marked at an assay office shall state in writing, in manner provided by the Governor-General of the Irish Free State upon the advice of the Executive Council of the Irish Free State, whether the plate or article was wrought or made in Saorstát Eireann, or was imported from a place outside Saorstát Eireann:

AND WHEREAS it is enacted by sub-section (3) of the said Section 1 as so adapted, that where any person, who, after the date fixed by order of the Governor-General of the Irish Free State acting on the advice of the Executive Council of the Irish Free State, brings or causes to be brought any plate or other article to be assayed, stamped and marked at an assay office, does not know and is not able to state whether the plate or other article was wrought or made in Saorstát Eireann or was imported from a place outside Saorstát Eireann, such person shall make a statement in writing to that effect in the manner prescribed in the said Section 1, and the plate or other article referred to in the said statement shall be stamped and marked as if it were imported from a place outside Saorstát Eireann:

NOW, THEREFORE, I, DONAL BUCKLEY, Governor-General of the Irish Free State, upon the advice of the Executive Council of the Irish Free State and in exercise of the powers conferred by the Hall-marking of Foreign Plate Act, 1904, as adapted by or under the Adaptation of Enactments Act, 1922 (No. 2 of 1922), and of every and any other power me in this behalf enabling do hereby order as follows:—

1. This Order may be cited as the Hall-marking of Imported Plate Order, 1935.

2. The Interpretation Act, 1889, applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas passed before the 1st day of January, 1924.

3. Where any plate or article imported from a place outside Saorstát Eireann is brought to the assay office of the Fraternity or Company of Goldsmiths of the City of Dublin to be assayed, stamped or marked, such plate or article shall be marked by the said assay office of the Fraternity or Company of Goldsmiths of the City of Dublin with, in the case of any gold plate or article, the marks set forth in the First Part of the First Schedule hereto and with, in the case of any silver plate or article, the marks set forth in the Second Part of the said Schedule.

4. The Statement in writing to be made by any person (other than an officer of customs who is exempted from making such statement) who brings or causes to be brought any plate or other articles to be assayed, stamped or marked at the assay office of the Fraternity or Company of Goldsmiths of the City of Dublin shall be in whichever of the forms set forth in the Second Schedule hereto is applicable to the circumstances of the case and the directions contained in or appended to the said forms shall be complied with by every such person.

5. The Order in Council made on the 11th day of May, l906, under Section 1 of the Hall-marking of Imported Plate Act, 1904, is hereby revoked.

6. This Order shall come into operation on the 1st day of August, 1935.

PART I.

ANY IMPORTED GOLD PLATE OR ARTICLE.

1. The Hall-mark of the Fraternity or Company of Goldsmiths of the City of Dublin, that is to say: v13p0007a.gif

2. The carat value of the Gold in any imported gold plate or article and the decimal equivalent of such carat value, both marked with whichever of the following figures and signs is applicable to such plate or article, that is to say,

either v13p0007b.gif or v13p0007c.gif or v13p0007d.gif or v13p0007e.gif

3. A mark which denotes the annual date letter.

PART II.

ANY IMPORTED SILVER PLATE OR ARTICLE.

1. The Hall-mark of the Fraternity or Company of Goldsmiths of the City of Dublin, that is to

2. The standard value of the Silver in any imported silver plate or article and the decimal equivalent of such standard value both marked with whichever of the following figures and signs is applicable to such plate or article, that is to say,

either v13p0007g.gif or v13p0007h.gif

3. A mark which denotes the annual date letter.

NOTE.—In this Schedule the actual sizes of the marks are not shown.
