HOME-GROWN WHEAT (PURCHASE PERCENTAGE FOR CEREAL YEAR 1935-36) (AMENDMENT) ORDER, 1935.

HOME-GROWN WHEAT (PURCHASE PERCENTAGE FOR CEREAL YEAR 1935-36) (AMENDMENT) ORDER, 1935.

WHEREAS it is enacted by sub-section (1) of Section 10 of the Agricultural Produce (Cereals) Act, 1935 (No. 26 of 1935), that the Minister for Agriculture may before the commencement of any cereal year make an order (in the said section referred to as a purchase percentage order) requiring that of the home-grown wheat quotas, for all mills which are licensed mills at the commencement of such cereal year, for such cereal year a percentage (in this said section referred to as the purchase percentage) fixed by such order shall be purchased and taken into store in such cereal year before the end of each month, specified in such order, in such cereal year, and such percentage may, in respect of any one month in such cereal year, be fixed at one hundred per cent., and it is enacted by sub-section (2) of the said section that where a purchase percentage order has been made in relation to any cereal year, the said Minister may, whenever and so often as he thinks fit, by order amend such purchase percentage order, in respect of any month or months in such cereal year commencing after the date of such order, by increasing or reducing the purchase percentage for such month or months or, in respect of any month in such cereal year current at the date of such order, by reducing the purchase percentage for such month;

AND WHEREAS the Home-grown Wheat (Purchase Percentage for Cereal Year 1935-36) Order, 1935 (Statutory Rules and Orders, No. 316 of 1935), was made by the Minister for Agriculture under sub-section (1) of the said Section 10;

NOW, THEREFORE, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by sub-section (2) of Section 10 of the Agricultural Produce (Cereals) Act, 1935 (No. 26 of 1935) and of every and any other power me in this behalf enabling, do hereby order as follows:—

1. This Order may be cited as the Home-grown Wheat (Purchase Percentage for Cereal Year 1935-36) (Amendment) Order, 1935.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. The Home-grown Wheat (Purchase Percentage for Cereal Year 1935-36) Order, 1935 (Statutory Rules and Orders No. 316 of 1935), is hereby amended in the following respects and shall be construed and have effect accordingly, that is to say:—

(a) by the substitution in the second column of the Schedule to the said Order of the percentage "55%" for the percentage "65%" now contained therein, and

(b) by the substitution in the said second column of the percentage "60%" for the percentage "80%" now contained therein, and

(c) by the substitution in the said second column of the percentage "80%" for the percentage "85%" now contained therein.
