BY-LAW No. 431 OYSTER FISHERIES

KILLARY HARBOUR.


I, SÉAMAS Ó RIAIN, Minister for Agriculture, by virtue and in exercise of the powers vested in me by the Fisheries Act, 1925 , the Fisheries (Re-distribution of Public Services) Order, 1934, and of every other power enabling me in this behalf, DO MAKE AND ORDAIN THE FOLLOWING BY-LAW :—

(1) All persons engaged in fishing for, or taking, Oysters in Killary Harbour, or in any of the bays or inlets thereof, shall, immediately on any Oysters being brought on board any boat, cull all such Oysters as may be taken, and shall immediately throw back on the Oyster Beds all Oysters of less dimensions than three inches at the greatest diameter thereof, as well as all gravel and fragments of shells raised or taken while engaged in such fishing ; and shall not remove from any fishing ground or Oyster Bed any Oyster of less dimensions than three inches at the greatest diameter thereof ; and no person shall pick, gather, or take, from any rock, strand, or shore, of Killary Harbour, or of any of the bays or inlets thereof, by any means whatsoever, any Oyster of less dimensions than three inches at the greatest diameter thereof, nor sell, expose for sale or have in his possession any Oysters of less dimensions than aforesaid.

(2) Each and every person offending against this By-Law shall forfeit and pay for each offence a sum not exceeding Five Pounds.

(3) The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this By-Law in like manner as it applies to the interpretation of an Act of the Oireachtas.

(4) This By-Law may be cited for all purposes as the Killary Harbour Oyster By-Law No. 431, 1937.
