CONTROL OF IMPORTS (QUOTA No. 8) (AMENDMENT) ORDER, 1938. | ||
WHEREAS it is enacted by Section 11 of the Control of Imports Act, 1934 (No. 12 of 1934), as adapted in consequence of the enactment of the Constitution, that the Government may at any time by order amend any quota order previously made under that Act : | ||
AND WHEREAS the power of amendment conferred by the said Section 11 was extended in certain respects by Section 3 of the Control of Imports (Amendment) Act, 1937 (No. 8 of 1937) : | ||
AND WHEREAS the Control of Imports (Quota No. 8) Order, 1934 (Statutory Rules and Orders, No. 287 of 1934), is a quota order within the meaning of the said Section 11 and was made under the said Control of Imports Act, 1934 : | ||
NOW, the Government, in exercise of the powers conferred on them by Section 11 of the Control of Imports Act, 1934 (No. 12 of 1934), and by Section 3 of the Control of Imports (Amendment) Act, 1937 (No. 8 of 1937), and of every and any other power them in this behalf enabling, hereby order as follows :— | ||
1. This Order may be cited as the Control of Imports (Quota No. 8) (Amendment) Order, 1938. | ||
2. This Order shall come into operation on the 19th day of May, 1938. | ||
3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. | ||
4. (1) In this Order the expression " the Principal Order " means the Control of Imports (Quota No. 8) Order, 1934 (Statutory Rules and Orders, No. 287 of 1934). | ||
(2) Every expression and word to which a particular meaning is given by the Principal Order for the purposes of that Order has, in this Order, the meaning so given to it. | ||
5. The description, contained in paragraph 4 of the Principal Order, of the goods the importation of which is prohibited by that paragraph is hereby amended by the exclusion from that description of any motor car chassis with body attached constituting, in the opinion of the Revenue Commissioners, a completely assembled motor car which— | ||
(a) is shown, to the satisfaction of the Revenue Commissioners, to be imported by a trader in motor cars for the purpose of re-sale, and | ||
(b) is of a value, for the purpose of the Customs Acts, of not less than seven hundred and fifty pounds, and | ||
(c) is shown, to the satisfaction aforesaid, to have been manufactured in the United Kingdom of Great Britain and Northern Ireland, or in the Channel Islands, or in the Isle of Man, or in the Dominion of Canada, and | ||
(d) is shown, to the satisfaction aforesaid, to be of a type which is ordinarily kept for the personal use of the owner and members of his family or household. | ||
