VOCATIONAL EDUCATION (ADDITIONAL GRANTS) REGULATIONS, 1938.

VOCATIONAL EDUCATION (ADDITIONAL GRANTS) REGULATIONS, 1938.

WHEREAS it is enacted by sub-section (1) of section 53 of the Vocational Education Act, 1930 (No. 29 of 1930), that the Minister for Education may, out of moneys provided by the Oireachtas, make grants to vocational education committees in aid of expenditure under annual schemes in accordance with regulations made by the said Minister with the approval of the Minister for Finance:

NOW, I, TOMÁS Ó DEIRG, Minister for Education, in exercise of the powers conferred on me by section 53 of the Vocational Education Act, 1930 (No. 29 of 1930), and of every and any other power me in this behalf enabling, and with the approval of the Minister for Finance, do hereby make the following regulations:—

1. These Regulations may be cited as the Vocational Education (Additional Grants) Regulations, 1938.

2. In these Regulations—

the expression "the Act" means the Vocational Education Act, 1930 , (No. 29 of 1930);

the expression "the Minister" means the Minister for Education; the word "committee" means a vocational education committee; the expression "the Dublin City Vocational Education area" means the vocational education area which is the county borough of Dublin;

the expression "the Dun Laoghaire Vocational Education area" means the vocational education area which is the Borough of Dun Laoghaire.

3. The Interpretation Act, 1937 , (No. 38 of 1937), applies to these Regulations.

4. (1) Where in the financial year commencing on the 1st day of April, 1938, the annual local contribution paid by a rating authority to a committee exceeds the minimum annual liability of such rating authority in respect of such committee by any sum (in these Regulations referred to as the contribution excess), the Minister may, in that financial year, make to such committee under section 53 of the Act a grant (to be called and known as an Additional Grant) of an amount not exceeding—

(a) if such committee is the committee for a borough vocational education area (other than the Dublin City Vocational Education area) or for an Urban district vocational education area (other than the Dun Laoghaire Vocational Education area) an amount equal to four times the contribution excess; or

(b) if such committee is the committee for the Dun Laoghaire Vocational Education area, an amount equal to twice the contribution excess; or

(c) if such committee is the committee for a county vocational education area, or for the Dublin City Vocational Education area, an amount equal to the contribution excess.

(2) For the purposes of any calculation made in accordance with this Regulation—

(a) Special statutory provisions for the different assessment of particular kinds of property or particular parts of the area of a rating authority shall be disregarded; and

(b) any fraction of a pound equal to or less than the sum of ten shillings may be disregarded and every other such fraction may be treated as a pound; and

(c) the expression "the minimum annual liability" has the meaning assigned to it by sub-section (2) of Section 43 of the Act, as amended by Section 3 of the Vocational Education (Amendment) Act, 1936 (No. 50 of 1936).

5. (1) Where the Minister is satisfied that the City of Cork Vocational Education Committee is making adequate and suitable provision for the supply of continuation education in its area in accordance with Part III of the Act, and the said Committee has in any financial year provided compulsory courses, the Minister, in addition to the Additional Grant, may, in respect of that financial year, make under Section 53 of the Act to the said Committee a grant (to be called and known as a Supplemental Grant) not exceeding so much of the total expenditure (including non-recurring expenditure) of the said Committee in that financial year as is, in the opinion of the Minister, referable to the provision of compulsory courses, and the enforcement of Part V of the Act.

(2) In this Regulation the expression "compulsory courses" means courses of instruction in the nature of continuation education provided under sub-section (1) of Section 61 of the Act.
