CONTROL OF IMPORTS (QUOTA No. 13, TENTH PERIOD, ADDITIONAL QUOTA) ORDER, 1939. | ||
WHEREAS it is enacted by subsection (4) of section 6 of the Control of Imports Act, 1934 (No. 12 of 1934), as adapted in consequence of the enactment of the Constitution, that whenever the Government has, by order made under that section, appointed a quota in respect of any quota period, the Government may, if they so think fit, by order made before the expiration of such quota period, increase such quota by such amount (in that Act referred to as an additional quota) as they think proper : | ||
AND WHEREAS by the Control of Imports (Quota No. 13, Tenth Period) Order, 1938 (Statutory Rules and Orders, No. 260 of 1938), the Government appointed the period beginning on the 1st day of November, 1938, and ending on the 30th day of April, 1939, to be the tenth quota period under the Control of Imports (Quota No. 13) Order, 1935 (Statutory Rules and Orders, No. 59 of 1935), which relates to certain woven tissues of wool or worsted, and appointed three hundred thousand square yards of the articles to which the said Control of Imports (Quota No. 13) Order, 1935, applies to be the quota in respect of the said tenth quota period : | ||
AND WHEREAS by the Control of Imports (Quota No. 13) (Amendment) Order, 1937 (Statutory Rules and Orders, No. 53 of 1937), the said Control of Imports (Quota No. 13) Order, 1935, was amended by the deletion in paragraph (d) of Part I of the Schedule thereto of the words " are more than one shilling and three pence " and the substitution therefor of the words " exceed two shillings " : | ||
AND WHEREAS it is enacted by subsection (1) of section 9 of Control of Imports Act, 1934 , as amended by subsection (1) of section 10 of the Control of Imports (Amendment) Act, 1937 (No. 8 of 1937), that whenever and so long as a quota order made under the Control of Imports Act, 1934 , is in force, any person who is for the time being registered in the register of importers maintained in pursuance of the Control of Imports Act, 1934 , for the purposes of such quota order may, not less than fourteen clear days before the commencement of any quota period under such quota order or, in the case of an application in relation to an additional quota, within such time as shall be appointed in that behalf by the order fixing such additional quota, apply in the prescribed manner to the Minister for Industry and Commerce for a licence to import during such quota period a specified quantity of goods to which the said quota order applies : | ||
NOW, the Government, in exercise of the powers conferred on them by the Control of Imports Acts, 1934 and 1937, as adapted in consequence of the enactment of the Constitution, and of every and any other power them in this behalf enabling, do hereby order as follows :— | ||
1. This Order may be cited as the Control of Imports (Quota No. 13, Tenth Period, Additional Quota) Order, 1939. | ||
2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. | ||
3. The quota appointed by the Control of Imports (Quota No. 13, Tenth Period) Order, 1938, in respect of the tenth quota period appointed by that Order, is hereby increased by fifty thousand square yards of the articles to which the Control of Imports (Quota No. 13) Order, 1935, applies, to the intent that the said fifty thousand square yards shall be an additional quota in respect of the said tenth quota period, and the total quota in respect of the said tenth quota period shall be three hundred and fifty thousand square yards of the articles to which the Control of Imports (Quota No. 13) Order, 1935, applies. | ||
4. Every application made in relation to the additional quota specified in this Order for a licence to import any quantity of the articles to which the Control of Imports (Quota No. 13) Order, 1935, applies shall be made within seven days after the date of this Order. | ||
