No. 254/1939:

POISONS (IRELAND) ACT, 1870 (ADDITIONAL POISONS) ORDER, 1939.

POISONS (IRELAND) ACT, 1870 (ADDITIONAL POISONS) ORDER, 1939.

WHEREAS it is enacted by Section 1 of the Poisons (Ireland) Act, 1870, as adapted by or under subsequent enactments, that the several articles mentioned in the Schedule A to the said Act shall be deemed to be poisons within the meaning of the said Act, and that the Royal College of Physicians of Ireland (in the said Section 1 referred to as the King and Queen's College of Physicians in Ireland) may from time to time, by resolution, declare that any article other than those mentioned in the said Schedule and in such resolution named ought to be deemed a poison within the meaning of the said Act, and thereupon the said College shall submit the said resolution for the approval of the Government, and if such approval shall be given, then such resolution and approval shall be advertised in the Iris Oifigiuil, and on the expiration of one month from such advertisement the article named in such resolution shall be deemed to be a poison within the meaning of the said Act :

AND WHEREAS on the 3rd day of March, 1939, the Royal College of Physicians of Ireland passed the following resolution, that is to say :

" That the President and Fellows of the Royal College of Physicians of Ireland, in exercise of the powers vested in them, do hereby resolve and declare that Salts of Thallium should be added to Part II of Schedule A of the Sale of Poisons (Ireland) Act, 1870 " :

AND WHEREAS on the 5th day of May, 1939, the Royal College of Physicians of Ireland passed the following resolution, that is to say :—

" That the President and Fellows of the Royal College of Physicians of Ireland recommend that the following substances be added to Part I of Schedule A of the Sale of Poisons (Ireland) Act : Barbituric Acid ; its salts ; derivatives of Barbituric Acid ; their salts, compounds of Barbituric Acid, its salts, its derivatives, their salts, with any other substance.

" That the following substances be added to Part II of Schedule A of the Sale of Poisons (Ireland) Act : Synthetic Ephedrine Alkaloids and their salts ; Benzedrine and its salts " :

NOW, the Government, in exercise of the powers conferred on them by Section 1 of the Poisons (Ireland) Act, 1870, as adapted by or under subsequent enactments, and of every and any other power them in this behalf enabling, do hereby order as follows :—

1. The hereinbefore recited resolutions dated respectively, the 3rd day of March, 1939, and the 5th day of May, 1939, of the Royal College of Physicians of Ireland are hereby approved of.

2. This Order may be cited as the Poisons (Ireland) Act, 1870 (Additional Poisons) Order, 1939.
