DEFENCE FORCES (BILLETING DURING A PERIOD OF EMERGENCY) REGULATIONS, 1940.

I, OSCAR TRAYNOR, Minister for Defence, in exercise of the powers conferred on me by section 12 of the Defence Forces (Temporary Provisions) (No. 2) Act, 1940 (No. 11 of 1940), do hereby, with the sanction of the Minister for Finance, so far as these regulations relate to the scales of payment to be made thereunder, make the following regulations, that is to say :—

1. These Regulations may be cited as the Defence Forces (Billeting during a Period of Emergency) Regulations, 1940.

2.—(1) Subject to the provisions of these Regulations, an officer may, during a period of emergency, serve on—

(a) the occupier of any premises a requisition (in these Regulations referred to as a billeting requisition) requiring him to provide during a period of emergency for members of the Defence Forces any accommodation of the kind specified in the second column of Part I of the First Schedule hereto opposite reference numbers 1, 2, 3, 4, 5, 6, 7 or 8 in the first column of the said Part I;

(b) the occupier of any premises or any livery stable a requisition (in these Regulations also referred to as a billeting requisition) requiring him to provide during a period of emergency for horses of the Defence Forces any accommodation of the kind specified in the second column of Part I of the First Schedule hereto opposite reference numbers 9 or 10 in the first column of the said Part I;

(c) the occupier of any premises or any garage a requisition (in these Regulations also referred to as a billeting requisition) requiring him to provide during a period of emergency, accommodation of the kind specified in the second column of Part I of the First Schedule hereto opposite reference number 11 in the first column of the said Part I.

(2) Every billeting requisition shall :—

(a) specify the place at which the accommodation required thereunder is to be provided, the number of officers, soldiers, horses or mechanically propelled vehicles to be accommodated thereunder, the nature of such accommodation, and the period of such accommodation, and

(b) be in the form set out in the Second Schedule hereto.

(3) No billeting requisition requiring lodging for any officer or soldier shall be made in respect of any premises which are occupied solely by women or by women and children.

(4) A billeting requisition in respect of any premises may be served on the occupier of those premises by delivering such requisition to him or leaving it at such premises with a person over the age of sixteen years.

3.—(1) Where any accommodation of the kind specified in the second column of Part I of the First Schedule hereto opposite any reference number in the first column of the said Part I is provided in pursuance of a billeting requisition the scale of payment therefor shall be that specified in the third column of the said Part I opposite such reference number.

(2) Where any accommodation of the kind specified in the second column of Part II of the First Schedule hereto opposite any reference number in the first column of the said Part II is required to be provided in pursuance of a billeting requisition, such accommodation shall consist of the items set out in the third column of the said Part II, opposite such reference number but, if such accommodation is a meal, any other item of food may, with the consent of an officer, be substituted for any item of such meal so set out, or if such accommodation is forage, any other item of forage may, with the consent of an officer, be substituted for any item of forage so set out.

(3) Where a billeting requisition requires lodging to be provided for a member of the Defence Forces a separate bed shall be provided for such member.

4.—(1) Where accommodation has, in pursuance of a billeting requisition, been provided by the occupier of any premises for the members of any unit of the Defence Forces or by the occupier of any premises or livery stables for horses belonging to any unit of the Defence Forces or by the occupier of any premises or garage for mechanically propelled vehicles belonging to any unit of the Defence Forces, the commanding officer of such unit or an officer acting on behalf of such commanding officer for the purpose shall, as soon as may be after each accounting period, issue to such occupier a certificate in the form set out in the Third Schedule hereto, containing the particulars, in relation to the accommodation provided by such occupier during such accounting period, indicated in the said form.

(2) Each of the following periods shall be an accounting period for the purposes of this Regulation :—

(a) in case accommodation is provided for not more than four consecutive days, the period during which such accomodation is provided,

(b) in case accommodation is provided for more than four consecutive days—

(i) each complete period of four days during which such accommodation is provided,

(ii) the period (if any) of less than four days ending on the date on which such accommodation ceases to be provided.

(3) Where any person claims payment in respect of any accommodation furnished by him in pursuance of a billeting requisition, he shall forward such claim and the certificates issued under this Regulation in respect of such accommodation to the Secretary, Department of Defence, Dublin, or to such other person as the officer issuing such certificate may indicate.

5. If any person upon whom a billeting requisition has been served refuses or neglects to provide the accommodation specified in such billeting requisition or to provide such accommodation in accordance with these Regulations, such person shall be guilty of an offence under these Regulations and shall be liable on summary conviction thereof to a fine not exceeding five pounds.
