TRANSFER OF ADMINISTRATION AND FUNCTIONS (TURF) ORDER, 1941. | ||
WHEREAS it is enacted by sub-section (1) of Section 6 of the Ministers and Secretaries (Amendment) Act, 1939 (No. 36 of 1939), that it shall be lawful for the Government, whenever they so think proper, to do by order all or any of certain things mentioned in that sub-section, and, amongst others, to transfer the administration and business of any particular public service or of any branch or part of any such particular public service from any Department of State to any other Department of State and to make all such transfers of officers and property and do all such other things as shall be incidental to or consequential on such transfer of administration and business, to transfer from any Minister having charge of a Department of State to the Minister having charge of any other Department of State any particular power, duty, or other function vested by or under any statute or otherwise in the said first-mentioned Minister, and to make all such adaptations of enactments as shall appear to the Government to be consequential on anything done by them under the said sub-section: | ||
AND WHEREAS the Department of Industry and Commerce includes the administration and business of the public service in connection with turf: | ||
AND WHEREAS certain powers and duties are conferred or imposed on the Minister for Industry and Commerce by the Turf (Use and Development) Act, 1936 (No. 23 of 1936): | ||
NOW, the Government, in exercise of the powers conferred on them by sub-section (1) of Section 6 of the Ministers and Secretaries (Amendment) Act, 1939 (No. 36 of 1939), and of every and any other power them in this behalf enabling, do hereby order as follows:—, | ||
1. This Order may be cited as the Transfer of Administration and Functions (Turf) Order, 1941. | ||
2. In this Order, the expression " the Act " means the Turf (Use and Development) Act, 1936 (No. 23 of 1936). | ||
3. The administration and the business of the public service in connection with turf and all powers, duties and functions connected with the same are hereby transferred from the Department of Industry and Commerce to the Department of Finance. | ||
4. Each and every of the several powers conferred on the Minister for Industry and Commerce by the Act is hereby transferred to the Minister for Finance. | ||
5. Each and every of the several duties imposed on the Minister for Industry and Commerce by the Act is hereby transferred to the Minister for Finance. | ||
6. the Act shall be construed and have effect as if in Section 1 thereof, in lieu of the definition of the expression " the Minister " now contained therein, the said expression were defined as meaning the Minister for Finance. | ||
