BY-LAW No. 446. CASTLEMAINE HARBOUR MUSSEL FISHERIES.

BY-LAW No. 446. CASTLEMAINE HARBOUR MUSSEL FISHERIES.

I, SÉAMAS Ó RIAIN, Minister for Agriculture, in exercise of the powers exercisable by me under the Fisheries Acts, 1842 to 1939, and of every and any other power me in this behalf enabling, do hereby make the following By-Law, that is to say :--

(1) This By-Law may be cited as the Castlemaine Harbour (Mussel Fisheries) By-Law, No. 446, 1941.

(2) This By-Law shall come into operation on the 1st January, 1942.

(3) The Interpretation Act, 1937 (No. 38 of 1937), applies to this By-Law.

(4) It shall not be lawful for any person to sell or offer for sale for human consumption, or have in his possession for the purpose of sale for human consumption, mussels taken or dredged in that portion of Castlemaine Harbour which lies inside or to the eastward of an imaginary straight line from Aughils Bridge in the Townland of Aughils to Crow Point in the Townland of Cromane Lower, both in the County of Kerry, provided always that such prohibition shall not extend to mussels in transit from the said portion of Castlemaine Harbour for treatment at the approved mussel purification plant at Cromane in the said County of Kerry or to mussels after treatment in said plant.

(5) It shall not be lawful for any person to export or attempt to export mussels, not intended for human consumption, taken or dredged inside or to the eastward of an imaginary straight line from Rosbehy Point to Inch Point, both in the County of Kerry unless each container of such mussels bears a label on which the words " Bait Mussels, not for Human Consumption," together with the name and address of the consignor, are legibly written or printed.

(6) Each and every person offending against this By-Law shall forfeit and pay for each offence a sum not exceeding Five Pounds.
