No. 169/1943:

ALIENS ORDER, 1943.

ALIENS ORDER, 1943.

I, GERALD BOLAND, Minister for Justice, in exercise of the powers conferred on me by Section 5 of the Aliens Act, 1935 (No. 14 of 1935), and of every and any other power me in this behalf enabling, do hereby order as follows :—

1. (1) This Order may be cited as the Aliens Order, 1943.

(2) The Aliens Orders, 1935 to 1941, and this Order may be cited together as the Aliens Orders, 1935 to 1943.

2. (1) In this Order—

the expression " the Principal Order " means the Aliens Order, 1935 ( S. R. & O. No. 108 of 1935 ), as amended by any subsequent Order ;

the expression " exempted person " means a person to whom the Aliens (Exemption) Order, 1935 ( S. R. & O. No. 80 of 1935 ), applies.

(2) Every word and expression to which a particular meaning is given by the Principal Order for the purposes of that Order shall in and for the purposes of this Order have the meaning so given.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. Paragraph (1) of Article 5 of the Principal Order is hereby amended by the deletion of the words " other than Great Britain or Northern Ireland ".

5. An alien (other than an exempted person or a seaman) coming by sea or air from outside the State shall not, without the permission of the Minister, land in the State elsewhere than at a port specified in the Schedule to this Order.

6. The master of any ship landing or embarking passengers coming from or bound for a destination outside the State at any port in the State shall furnish to such person and in such manner as the Minister may direct, either generally or in any particular case, particulars with respect to any passengers who are aliens and are not exempted persons, and any passengers shall furnish to the master of the ship any information required by him for the purpose of the return.

7. (1) The following provisions of the Principal Order are hereby revoked, that is to say—paragraphs (4), (5) and (6) of Article 5, Articles 6 and 8 and the First Schedule.

(2) The Aliens (Amendment) Order, 1936 ( S. R. & O. No. 75 of 1936 ) is hereby revoked.
