BY-LAW No. 457. CORK AND KERRY. | ||
ESCALLOP FISHING. | ||
I, SÉAMAS Ó RIAIN, Minister for Agriculture, in exercise of the powers now exercisable by me under the Fisheries Acts, 1842 to 1944 and of every and any other power me in this behalf enabling, do hereby make the following By-Law, that is to say :— | ||
1. This By-Law may be cited as the Cork and Kerry Escallop By-Law No. 457. | ||
2. This By-Law shall come into operation on the 7th day of October, 1946. | ||
3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this By-Law. | ||
4. Bantry and Dunmanus Bays Escallop By-Law No. 452, 1943, IS HEREBY REVOKED. | ||
5. IT IS PROHIBITED from the twentieth day of April to the twentieth day of October in every year, both said days inclusive, to take any escallop from that part of the sea off the coasts of Counties Cork and Kerry lying between the mainland of the said Counties and imaginary straight lines drawn from the western extremity of Mizen Head in the County of Cork and thence to the western extremity of Dursey Island and thence to the western extremity of Hog Island and thence to the Lemon Rock and thence to the western extremity of the Great Blasket Island and thence to Sybil Point in the County of Kerry. | ||
6. IT IS PROHIBITED to bring to land, or to sell, expose for sale, purchase, carry or have in possession within the aforesaid part of the sea or within two miles of High Water Mark on the shores thereof any Escallop of a smaller size than four and a half inches measured across its greatest width. | ||
7. Every person who shall take an Escallop of a smaller size than four and a half inches measured across its greatest width from the aforesaid part of the sea shall forthwith return same to the sea. | ||
8. Each and every person offending against this By-Law shall forfeit and pay for each offence a sum not exceeding Five Pounds. | ||
