I, DANIEL MORRISSEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)) and of every and any other power me in this behalf enabling, hereby order as follows :--

Short title and commencement.

1.--(1) This Order may be cited as the Home-Grown Timber (Maximum Prices) Order, 1949.

(2) This Order shall come into operation on the 6th day of July, 1949.

Definitions.

2.--(1) In this Order--

the expression " Class A Premises " means a saw mill or the premises of a timber merchant in operation on the same site for five years or more and drawing more than half of its supplies of timber by road, rail or canal from places more than ten miles distant therefrom ;

the expression " Class B Premises " means a saw mill or t premises of a timber merchant not being Class A premises.

(2) References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

(3) References in this Order to purchasing shall be construed as including references to agreeing or offering to purchase or to inviting an offer to sell.

Exclusion from application of this Order.

3. This Order shall not apply to the purchase or sale of--

(a) timber of exceptional specifications for railways, canals, shipyards, docks or transmission lines,

(b) hardwood quartered boards for panelling,

(c) hardwood boards exceeding twenty inches in width suitable for coachbuilding or vanbuilding, or

(d) selected timber for the manufacture of matches.

Maximum prices for sawn timber.

4.--(1) No person shall sell or purchase sawn timber of a type and description mentioned in Part I, II or III of the Schedule to this Order at a price exceeding the appropriate price indicated in respect thereof in that Part of the Schedule.

(2) The provisions set out in Part IV of the Schedule to this Order shall have effect in relation to the preceding Parts of the Schedule.

(3) The provisions set out in Part V of the Schedule to this Order shall have effect in the circumstances mentioned in those provisions.

Indication of class of premises on quotations, etc., used in connection with sale of sawn timber.

5. No person shall sell any sawn timber unless there is indicated, on every quotation, estimate, invoice or other document used in connection with the sale, the class for the purposes of this Order to which the premises from which the sawn timber is despatched belong.

6. The Emergency Powers (Timber other than Firewood) (Maximum Prices) Order, 1944 (S. R. & O. No. 5 of 1944), is hereby revoked.

PART IV.

1. All dimensions mentioned in the preceding Parts of this Schedule shall be taken to be full and not nominal in the case of freshly sawn timber. In the case of timber seasoned down to 25 per cent. moisture content, a deduction of one-thirty second of an inch per inch in width and in thickness may be made.

2. Where sawn timber consisting of constructional timber of larch or other conifers or edged boards of larch or other conifers is sold and the purchaser has required specified lengths, widths, or lengths and widths, an addition not exceeding 5 per cent. in respect of such specified lengths or widths may be made in calculating the proper maximum price.

3. Where sawn timber is sold and the quantity of the timber is 10 cubic feet or less, an addition not exceeding 10 per cent. may be made in calculating the proper maximum price.

PART V.

1. Where sawn timber is sold at Class A Premises and is delivered at any place not more than five miles from the premises, no charge shall be made or paid for the delivery.

2. Where sawn timber is sold at Class B Premises and is delivered at rail or canal at loading point nearest the premises, no charge shall be made or paid for the delivery.
