I, JAMES M. DILLON, Minister for Agriculture, in exercise of the powers conferred on me by the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)), hereby order as follows :-- |

1.--(1) This Order may be cited as the Flour, Wheatenmeal and Bread Order, 1949 (Amendment) Order, 1950. |
||
(2) The Flour, Wheatenmeal and Bread Order, 1949 ( S.I. No. 8 of 1949 ), the Flour, Wheatenmeal and Bread Order, 1949 (Amendment) Order, 1949 ( S.I. No. 130 of 1949 ), and this Order shall be construed together as one Order and may be cited together as the Flour, Wheatenmeal and Bread Orders, 1949 and 1950. |
||
(3) In this Order, the expression " the Principal Order " means the Flour, Wheatenmeal and Bread Order, 1949 ( S.I. No. 8 of 1949 ). |
||
2.--(1) Where an authorised officer has reasonable grounds for believing that in any premises any flour or wheatenmeal is being produced, stored, sold or used in the manufacture of bread, confectionery, biscuits or any other commodity intended for sale-- |
||
(a) the authorised officer may at all reasonable times enter and inspect the premises, |
||
(b) the authorised officer may examine any flour, wheatenmeal, bread, confectionery, biscuits or other commodity containing flour or wheatenmeal which he finds in the course of any such inspection and take samples thereof without payment and without producing or tendering any ration document, |
||
(c) the proprietor of the premises, and any person employed by him therein, is hereby required to produce, at the request of the authorised officer, to such officer any books, documents or records which are in his power, possession or procurement and which relate to any such flour, wheatenmeal, confectionery, biscuits or other commodity, to permit such officer to inspect and take extracts from the books, documents or records and to give to such officer any information, which he may reasonably require, in regard to any entries in the books, documents or records. |
||
(2) Each of the following persons shall be an authorised officer for the purposes of this Article : |
||
(a) any officer of the Minister ; |
||
(b) any person appointed by the Minister to be an authorised officer for the purposes of this Article. |
||
3. To remove doubts, it is hereby provided that-- |
||
(a) in a prosecution for an offence consisting of a contravention of Article 13 of the Principal Order, it shall be a good defence if the defendant proves that the flour was distributed by Grain Importers (Éire) Limited at a price in excess of the price specified in subparagraph (a) of paragraph 2 of Article 6 of the Principal Order for straight-run flour and that he sold the flour at a price not exceeding 7/- per stone ; |
||
(b) in a prosecution for an offence consisting of a contravention of Article 17 of the said Order it shall be a good defence if the defendant proves that the bread was manufactured from flour distributed by Grain Importers (Éire) Limited at a price in excess of the price specified in subparagraph (a) of paragraph 2 of Article 6 of the Principal Order for straight-run flour and that he sold the bread at a price not exceeding 6d. per lb. |

4. Article 10 of the Principal Order (inserted by the Flour, Wheatenmeal and Bread Order, 1949 (Amendment) Order, 1949 ( S.I. No. 130 of 1949 )), is hereby amended as follows : |
||
(a) by the deletion of paragraph (1) ; |
||
(b) by the deletion, in paragraph (4), of the definition of " bread " for the purposes of the said paragraph (1). |
||
5. Article 16 of the Principal Order is hereby amended by the insertion, in paragraph (c) of the definition of " fancy bread ", of the following subparagraphs : |
||
" (xii) Nutrex--produced by Bolands, Ltd., of Dublin ; |
||
(xiii) Numalt--produced by Bolands, Ltd., of Dublin ; |
||
(xiv) Teamalt--produced by W. A. McCaldin of Monaghan." |
||
6. No person, other than the holder of a milling licence, shall mix for sale or manufacture of bread standard wheatenmeal with any flour other than straight-run flour. |
||
