COAL (MAXIMUM PRICES) ORDER, 1951.

COAL (MAXIMUM PRICES) ORDER, 1951.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939) as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)) and of every and any other power me in this behalf enabling, hereby order as follows :--

1.--(1) This Order may be cited as the Coal (Maximum Prices) Order, 1951.

(2) This Order shall come into operation on the 5th day of September, 1951.

2. References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

3. In this Order--

" coal " has the meaning attached to it by custom in the trade but excludes anthracite ;

" specified area " means any area referred to in Article 4, Article 5 or Article 6 of this Order ;

" coal importing area " means any County Borough, Borough, Urban District, Town or Townland in any port or harbour of which coal is imported ;

" the August, 1951 price " means, in relation to coal, the price at which it was sold by retail in the week ended on the 4th day of August, 1951.

4.--(1) No person shall sell by retail coal in the County Borough of Dublin or in the Borough of Dún Laoghaire, under the conditions set out in Column (2) of Part I of the Schedule hereto, at a price exceeding a price calculated at the rate set out in Column (3) of the said Part at the appropriate reference number.

(2) No person shall offer or expose for sale by retail in the County Borough of Dublin or in the Borough of Dún Laoghaire coal under the conditions set out at reference number 1 or 2 in Column (2) of Part I of the Schedule hereto unless he has prominently displayed in his premises and on the vehicle, stall, barrow or other container from which coal is sold a plainly legibile notice stating the price at which such coal is offered for sale.

5. No person shall sell by retail coal in any area mentioned in Column (2) of Part II of the Schedule hereto at a price exceeding a price calculated in accordance with the rate set out in Column (3) of the said Part at the appropriate reference number.

6. No person shall sell by retail coal in any coal importing area other than the County Borough of Dublin or Borough of Dún Laoghaire or any area mentioned in Column (2) of Part II of the Schedule hereto at a price exceeding the August, 1951 price in that area.

7. Where--

(a) coal is brought from a specified area to a place which is not in a specified area, and

(b) it is supplied to a retailer in that place,

then, the maximum retail price which may be charged by him shall not exceed whichever of the following prices is appropriate--

(i) if the August, 1951 price in that place exceeded the August 1951 price in the specified area from which coal was brought as aforesaid--a price greater, by the amount of such excess, than the maximum retail price for the time being fixed for the specified area ;

(ii) in any other case--the maximum retail price for the time being fixed for the specified area.

8. Where a direction is given by the Minister in respect of any particular person or group of persons or in respect of any particular coal, the provisions of this Order shall, if and insofar as they are inconsistent with such direction, have effect subject to such direction.
