S.I. No. 212/1952:

SOCIAL WELFARE (OVERLAPPING PAYMENTS) REGULATIONS, 1952.

I, SÉAMAS Ó RIAIN, Minister for Social Welfare, in exercise of the powers conferred on me by section 3 and subsection (1) of section 75 of the Social Welfare Act, 1952 (No. 11 of 1952), and of every and any other power me in this behalf enabling, hereby make the following regulations :

1. These Regulations may be cited as the Social Welfare (Overlapping Payments) Regulations, 1952.

2. In these Regulations--

" the Acts " means the Widows' and Orphans' Pensions Acts, 1935 to 1952 ;

" child's (contributory) allowance " and " child's (non-contributory) allowance " have the same meanings as in the Acts ;

" increase of benefit " means--

(a) an increase of unemployment benefit under section 1 of the Unemployment Insurance Act, 1922, in respect of any child, or

(b) an increase of sickness or disablement benefit under subsection (4) of section 86 of the Social Welfare Act, 1952 (No. 11 of 1952), in respect of any child.

3. (1) Where a widow is in receipt of a child's (contributory) allowance in respect of any week, an increase of benefit shall not be payable to her in respect of any day in that week.

(2) Where a widow is in receipt of a child's (non-contributory) allowance in respect of any week, any increase of benefit payable to her in respect of any day in that week shall be payable at a weekly rate equal to the difference between the weekly rate of seven shillings and the weekly rate of the child's (non-contributory) allowance.

4. Where under the Acts a widows' (non-contributory) pension is reduced on grounds of means, then, for the purposes of these Regulations--

(a) in case the weekly rate of the pension is six shillings or more for a widow with one qualified child, the weekly rate of the child's (non-contributory) allowance shall be taken to be six shillings,

(b) in case the weekly rate of the pension is twelve shillings or more for a widow with two or more qualified children, the weekly rate of each child's (non-contributory) allowance shall be taken to be six shillings,

(c) in case the weekly rate of the pension is less than six shillings for a widow with one qualified child, the weekly rate of the child's (non-contributory) allowance shall be taken to be a rate equal to the weekly rate of the pension,

(d) in case the weekly rate of the pension is less than twelve shillings for a widow with two or more qualified children, the weekly rate of each child's (non-contributory) allowance shall be taken to be a rate equal to one half of the weekly rate of the pension.
