AIR NAVIGATION (OPERATIONS) ORDER, 1953 (AMENDMENT) ORDER, 1954.

AIR NAVIGATION (OPERATIONS) ORDER, 1953 (AMENDMENT) ORDER, 1954.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by the Air Navigation and Transport Acts, 1936 to 1950, hereby order as follows :

1.--(1) This Order may be cited as the Air Navigation (Operations) Order, 1953 (Amendment) Order, 1954.

(2) The Air Navigation (Operations) Order, 1953 ( S.I. No. 96 of 1953 ), and this Order may be cited together as the Air Navigation (Operations) Orders, 1953 and 1954.

(3) This Order shall come into operation on the 1st day of June, 1954.

2. In this Order " the Principal Order " means the Air Navigation (Operations) Order, 1953.

3. In paragraph (1) of Article 2 of the Principal Order--

(a) there shall be substituted for the definition of " night " :

" ' night ' means the hours between the end of evening civil twilight and the beginning of morning civil twilight, or such other period as may be specified by the appropriate authority. In or over the State, ' night ' shall be deemed to be, during the period of summer time, the time between one hour after sunset and one hour before sunrise, and, during the remainder of the year, the time between half-an-hour after sunset and half-an-hour before sunrise " ;

(b) in the definition of " take-off area," the words " which the aerodrome authority has declared " shall be deleted ; and

(c) in the definition of " take-off surface," the words " which the aerodrome authority has declared " shall be deleted.

4. In Article 20 of the Principal Order--

(a) in paragraph (2) (ii), after the word " elevation " there shall be inserted the words " and air temperature " ;

(b) in paragraph (2) (iv)--

(i) the words " in exceptional circumstances " shall be deleted,

(ii) for the word " area " in the ninth line there shall be substituted the words " additional area or distance."

(iii) the words " that the Minister has declared " shall be deleted ;

(c) (i) in paragraph (2) (v) (a), for the word " declared " there shall be substituted the words " or distance,"

(ii) for the words and figures " clear all obstacles within 200 feet or 60 metres on either side of the flight path by " there shall be substituted the words " attain a height of,"

(iii) after the word " vertically " there shall be inserted the words " above the take-off area " ;

(d) in paragraph (2) (v) (b),

(i) for the word " declared " there shall be substituted the words " or distance,"

(ii) for the words and figures " from 200 feet or 60 metres " there shall be substituted the words " by a horizontal margin,"

(iii) at the end thereof there shall be added the following :

" The margins shall be not less than 35 feet or 10·7 metres plus 0·005D vertically and not less than 200 feet or 60 metres plus one-half of the span of the wings of the aeroplane plus 0·125D horizontally, where D is the distance the aeroplane has travelled after passing the end of the take-off area or the end of any additional area or distance available in accordance with subparagraph (iv) of this paragraph, as the case may be " ;

(e) after paragraph (2) (v) there shall be added the following two subparagraphs :

" (vi) Permissible turn : For the purpose of compliance with the requirements of subparagraph (v) (b), of this paragraph the operator may plan a flight path which includes a turn of radius not less than the radius of steady turn specified in the Aeroplane Flight Manual of the aeroplane concerned.

(vii) Declaration of additional area or distance : With respect to the exception in subparagraph (iv) of this paragraph, if such additional area or distance has been declared suitable by the appropriate authority of the State in which the aerodrome is situated or by the Minister, no additional area or distance other than that so declared shall be used for the purpose of ensuring compliance with the provisions of subparagraphs (iv) and (v) of this paragraph." ;

(f) in paragraph (5), after subparagraph (i) (d) there shall be added the following subparagraph :

" (e) either the air temperature at which the take-off is made or a temperature approved in respect of the aerodrome by the appropriate authority of the State in which the aerodrome is situated or by the Minister."
