GARDA SÍOCHÁNA (APPOINTMENTS) REGULATIONS, 1945 (AMENDMENT) REGULATIONS, 1956.

GARDA SÍOCHÁNA (APPOINTMENTS) REGULATIONS, 1945 (AMENDMENT) REGULATIONS, 1956.

I, JAMES EVERETT, Minister for Justice, in exercise of the powers conferred on me by section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), hereby with the approval of the Government, make the following regulations :

1.--(1) These Regulations may be cited as the Garda Síochána (Appointments) Regulations, 1945 (Amendment) Regulations, 1956.

(2) The Garda Síochána (Appointments) Regulations, 1945 to 1951, the Garda Síochána (Appointments) Regulations, 1945 (Amendment) Regulations, 1954 ( S.I. No. 28 of 1954 ), and these Regulations may be cited together as the Garda Síochána (Appointments) Regulations, 1945 to 1956.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. The following provisions shall have effect in relation to paragraph (1) of Article 4 of the Garda Síochána (Appointments) Regulations, 1945 (Amendment) Regulations, 1951 ( S.I. No. 334 of 1951 ), and Article 7 of the Garda Síochána (Appointments) Regulations, 1945 (Amendment) Regulations, 1954 ( S.I. No. 28 of 1954 ) :

(i) subparagraph (i) of the said paragraph (1) and paragraph (a) of the said Article 7 shall each be construed as referring both to the Forces (as defined in subsection (3) of section 3 of the Defence Forces (Temporary Provisions) Act, 1923 (No. 30 of 1923)), and to the Permanent Defence Force as defined by the Defence Act, 1954 (No. 18 of 1954) ;

(ii) subparagraph (ii) of the said paragraph (1) shall be construed as referring both to the Reserve--First Line and to the Reserve of Officers (First Line) and the Reserve of Men (First Line) as constituted by the Defence Act, 1954 ;

(iii) subparagraph (iii) of the said paragraph (1) and paragraph (b) of the said Article 7 shall each be construed as referring both to An Fórsa Cosanta Áitiúil and to the Reserve of Officers (An Fórsa Cosanta Áitiúil) and the Reserve of Men (An Fórsa Cosanta Áitiúil) as constituted by the Defence Act, 1954 ;

(iv) subparagraph (iv) of the said paragraph (1) and paragraph (c) of the said Article 7 shall each be construed as referring both to An Slua Muirú and to the Reserve of Officers (An Slua Muirí) and the Reserve of Men (An Slua Muirí) as constituted by the Defence Act, 1954 .

EXPLANATORY NOTE.

The purpose of these regulations is to preserve the age-concession provisions in the Garda Síochána, (Appointments) Regulations for service in the various branches of the Defence Forces as constituted both before and after the coming into operation of the Defence Act, 1954 .
