BACON EXPORT SUBSIDY (No. 1) ORDER, 1958.

BACON EXPORT SUBSIDY (No. 1) ORDER, 1958.

In exercise of the powers conferred on them by Section 40 of the Pigs and Bacon (Amendment) Act, 1939 (No. 35 of 1939) and Section 13 of the Pigs and Bacon (Amendment) Act, 1956 (No. 37 of 1956) and with the concurrence of the Minister for Agriculture the Pigs and Bacon Commission hereby orders as follows :--

1. This Order may be cited as the Bacon Export Subsidy (No. 1) Order, 1958.

2. This Order shall apply only to bacon exported by a Licensee which was produced on the premises to which the Licensee's licence relates. For the purpose of this Order the bacon to which the Order applies shall be divided into three Classes :--

Class I shall mean exported bacon (other than bacon exported as ships' stores) of the quality and description defined in Section 3 hereof as being of Grade " A " standard.

Class II shall mean bacon exported as ships' stores, of the quality and description defined in Section 3 hereof as being of Grade " A " standard.

Class III shall mean all other exported bacon not falling within Class I or Class II.

3. In this Order " Bacon of Grade ' A ' Standard " means :--

(a) Wiltshire sides cut and trimmed according to good trade practice, of an ex-factory net weight of not less than 46 lb. and not more than 65 lb. of a quality and in a condition suitable for the best retail trade, and conforming to the following measurements of the exterior back fat including rind, viz. :--

Point of Measurement.

Maximum Measurement.

(i) Where the back fat is widest on the shoulder.

2 inches.

(ii) At the top of the muscle which curves out over the loin into the fat.

1 and 3/16th inches.

(iii) The centre of the middle (i.e. midway between points i and ii) and for seven centimetres on either side of the point of measurement.

1 and 3/16 inches.

Minimum Measurement.

(iv) The centre of the middle (as at iii above.)

¾th inch.

(b) Backs, Middles, Shoulderless Sides and Spencers (Gammonless Sides) cut and trimmed according to good trade practice, of a quality and in a condition suitable for the best retail trade and derived from the carcases of Grade " A " pigs as defined in the Pigs and Bacon Acts, 1935 to 1940 (Pigs and Bacon Commission) Regulations (No. 2) Order, 1955, as amended by Pigs and Bacon Acts 1935 to 1940 (Pigs and Bacon Commission) Regulations (Amendment) (No. 1) Order, 1956.

4. Subject as hereinafter provided every Licensee who exports bacon of any Class to which this Order applies shall be paid a subsidy at the rate hereinafter specified appropriate to bacon of such Class.

5. (a) In respect of Class I bacon the subsidy shall be at the rate of 67/- per cwt. on the net quantity exported on and after the 9th August, 1957, and not later than the 29th August, 1957 ; at the rate of 43/- per cwt. on the net quantity exported on and after the 30th August, 1957, and not later than the 5th September, 1957 ; at the rate of 24/- per cwt. on the net quantity exported on and after the 6th September, 1957, and not later than the 12th September, 1957 ; at the rate of 30/- per cwt. on the net quantity exported on and after the 13th September, 1957, and not later than the 19th September, 1957 ; at the rate of 70/- per cwt. on the net quantity exported on and after the 20th September, 1957, and not later than the 26th September, 1957 ; at the rate of 85/- per cwt. on the net quantity exported on and after the 27th September, 1957, and not later than the 3rd October, 1957 ; at the rate of 117/- per cwt. on the net quantity exported on and after the 4th October, 1957, and not later than the 7th November, 1957 ; at the rate of 107/- per cwt. on the net quantity exported on and after the 8th November, 1957, and not later than the 14th November, 1957 ; at the rate of 80/- per cwt. on the net quantity exported on and after the 15th November, 1957, and not later than the 26th December, 1957 ; at the rate of 87/- per cwt. on the net quantity exported on and after the 27th December, 1957, and not later than the 2nd January, 1958 ; at the rate of 102/- per cwt. on the net quantity exported on and after the 3rd January, 1958, and not later than the 9th January, 1958 ; and at the rate of 94/- per cwt. on the net quantity exported on and after the 10th January, 1958, and not later than the 16th January, 1958.

(b) In respect of Class II bacon exported during any period specified in the preceding sub-section, the subsidy on the net quantity exported shall be at the rate appropriate to Class I bacon exported during such period less 11s. 6d. per cwt.

(c) In respect of Class III bacon the subsidy shall be at the nominal rate of 1d. per cwt. on the net quantity exported on or after the 9th August, 1957, but no subsidy shall be payable in respect of bacon of this class exported on or after the 10th August, 1957.

(d) For the purpose of this Order the net quantity exported shall mean the net weight of bacon dispatched from the Licensee's premises less an allowance of 1% for shrinkage.

6. Bacon shall not be deemed to have been exported until such time as it shall have been cleared by the Customs Authorities at its destination.

7. Payment of the subsidy will be subject to compliance by the Licensee with such conditions as may be contained in Regulations made by the Commission.

8. This Order shall be deemed to have come into force on Friday, the 9th day of August, 1957.

9. Unless a contrary intention is indicated by the context all words and expressions used in this Order shall be construed as in the Pigs and Bacon Acts, 1935 to 1956.

EXPLANATORY NOTE.

This Order fixes the rates of subsidy payable to licensed bacon curers on bacon exported during the period from 9th August, 1957, to 16th January, 1958, inclusive.
