HOME-GROWN WHEAT (NATIONAL PERCENTAGE FOR CEREAL YEAR 1957-58) (VARIATION No. 2) ORDER, 1958.

HOME-GROWN WHEAT (NATIONAL PERCENTAGE FOR CEREAL YEAR 1957-58) (VARIATION No. 2) ORDER, 1958.

WHEREAS it is enacted by sub-section (1) of section 6 of the Agricultural Produce (Cereals) Act, 1935 (No. 26 of 1935) that the Minister for Agriculture, after consultation with the Minister for Industry and Commerce, shall, before the commencement of every cereal year make, in the case of the cereal year commencing next after the passing of the said Act, as soon as may be after such passing or, in the case of any other cereal year not later than eight months before the commencement of such cereal year, an order fixing for the purposes of the said section 6 a percentage in respect of such cereal year, and the Minister for Agriculture may, after the like consultation, during such cereal year by a further order or orders vary the amount of such percentage :

AND WHEREAS the Minister for Agriculture, in pursuance of the said sub-section (1), of the said section 6 made the Home-Grown Wheat (National Percentage for Cereal Year 1957-58) (Variation) Order, 1957 ( Statutory Instrument No. 213 of 1957 ) and, for the purposes of the said section 6 thereby fixed 90 per cent. as the percentage in respect of the cereal year commencing on the 1st day of September, 1957, and ending on the 31st day of August, 1958 :

AND WHEREAS the Minister for Agriculture has consulted with the Minister for Industry and Commerce in regard to the making of this Order :

NOW, THEREFORE, I, PATRICK SMITH, Minister for Agriculture, in exercise of the powers conferred on me by subsection (1) of section 6 of the Agricultural Produce (Cereals) Act, 1935 (No. 26 of 1935), do hereby order as follows :--

1. This Order may be cited as the Home-Grown Wheat (National Percentage for Cereal Year 1957-58) (Variation No. 2) Order, 1958.

2. The Interpretation Act, 1937 (No. 38 of 1937) applies to the interpretation of this Order.

3. Paragraph 3 (which fixes for the purposes of section 6 of the Agricultural Produce (Cereals) Act, 1935 (No. 26 of 1935) the percentage in respect of the cereal year commencing on the 1st day of September, 1957) of the Home-Grown Wheat (National Percentage for Cereal Year 1957-58) (Variation) Order, 1957 ( Statutory Instrument No. 213 of 1957 ) is hereby amended by the insertion therein of the words " seventy per cent " for the words " ninety per cent " now contained therein and the said Order shall be construed and have effect accordingly.

EXPLANATORY NOTE.

The Order require licensed millers to mill 70% (instead of 90% already prescribed) of their milling quotas n the form of home-grown wheat during the cereal year ending 31st August, 1958.
