BOVINE TUBERCULOSIS (CONTROL OF PUBLIC SALES OF CATTLE) (COUNTIES OF SLIGO, CLARE, GALWAY, LEITRIM, ROSCOMMON, DONEGAL AND MAYO) ORDER, 1959.

BOVINE TUBERCULOSIS (CONTROL OF PUBLIC SALES OF CATTLE) (COUNTIES OF SLIGO, CLARE, GALWAY, LEITRIM, ROSCOMMON, DONEGAL AND MAYO) ORDER, 1959.

I, PATRICK SMITH, Minister for Agriculture, it appearing to me to be necessary for the purpose of the progressive eradication of bovine tuberculosis, do hereby, in exercise of the powers conferred on me by section 22 of the Diseases of Animals Act, 1894, and section 2 of the Diseases of Animals (Bovine Tuberculosis) Act, 1957 (No. 14 of 1957), order as follows :--

Short title.

1. This Order may be cited as the Bovine Tuberculosis (Control of Public Sales of Cattle) (Counties of Sligo, Clare, Galway, Leitrim, Roscommon, Donegal and Mayo) Order, 1959.

Definitions.

2. In this Order--

" authorised officer " means a person appointed by the Minister to be an authorised officer for the purposes of this Order ;

" the Minister " means the Minister for Agriculture ;

" public sale of cattle " means any sale of cattle other than--

(a) a sale by a farmer of his own cattle on his own farm, or

(b) a sale of cattle specifically authorised by the Minister and held in accordance with any conditions attached to the authorisation.

Control of public sales of cattle.

3.--(1) A bovine animal aged one year or over shall not be exposed at any public sale of cattle which--

(a) is held on or after the 1st day of August, 1959, in the administrative county of Sligo, the administrative county of Clare or the administrative county of Galway, or

(b) is held on or after the 1st day of September, 1959, in the administrative county of Leitrim, the administrative county of Roscommon, the administrative county of Donegal or the administrative county of Mayo,

unless it has previously been subjected once or more often to a test specified in paragraph (2) of this Article and, in case it has been subjected to one such test only, it has passed that test or, in case it has been subjected to more than one such test, it has passed the last of those tests.

(2) The tests referred to in the foregoing paragraph are :--

(a) the single comparative intradermal tuberculin test with P.P.D. Weybridge mammalian and avian tuberculins,

(b) the single intradermal tuberculin test with P.P.D. Weybridge mammalian tuberculin or the single comparative intradermal tuberculin test with P.P.D. Weybridge mammalian and avian tuberculins, the mammalian reaction only being used to determine whether the animal has passed the test.

Powers of authorised officer.

4. An authorised officer, on production, if requested, of his authorisation, may examine any bovine animal aged one year or over exposed at any public sale of cattle referred to in Article 3 of this Order and may make any inquiries in relation to the animal as may be reasonably necessary for the administration of this Order.

EXPLANATORY NOTE.

This Order prohibits, as from 1st August, 1959, in Counties Sligo, Clare and Galway and as from 1st September, 1959 in Counties Leitrim, Roscommon, Donegal and Mayo, the exposure of cattle, aged one year or over, at any public sale unless they have previously been tested for tuberculosis and have passed the last test to which they were subjected. A public sale of cattle is defined in the Order as any sale of cattle other than a sale by a farmer of his own cattle on his own farm or a sale specifically authorised by the Minister.
