HEALTH (OFFICERS AGE LIMIT) DECLARATION, 1960.

The Minister for Health, being the appropriate Minister for the purposes of Part II of the Local Government Act, 1941 (No. 23 of 1941), in relation to the offices to which this Declaration applies, in exercise of the powers conferred on him by section 13 of the Local Government Act, 1941 , as adapted by the Health (Transfer of Departmental Administration and Ministerial Functions) Order, 1947 (S.R. & O. 1947 No. 58) and section 23 of the said Act as so adapted and as amended by section 24 of the Local Government Act, 1955 (No. 9 of 1955), hereby declares as follows :--

1. This Declaration may be cited as the Health (Officers Age Limit) Declaration, 1960.

2. (1) Subject to the provisions of paragraph (b) of subsection (5) of section 23 of the Local Government Act, 1941 (which subsection was inserted by section 24 of the Local Government Act, 1955 )--

(a) the age of sixty-five years shall be the age limit for every office under a local authority in relation to which the Minister for Health is the appropriate Minister for the purposes of Part II of the Local Government Act, 1941 , other than the office of district medical officer, and

(b) the age of seventy years shall be the age limit for the office of district medical officer under a local authority.

3. (1) The Local Government (Officers Age Limit) Order, 1946 (S.R. and O. 1946 No. 333), shall be revoked as from the first day of July, 1960, as respects every office of a class specified in the Schedule to the said Order in relation to which the Minister for Health is the appropriate Minister for the purposes of Part II of the Local Government Act, 1941 .

(2) The Health (Officers Age Limit) Order, 1950 ( S.I. No. 92 of 1950 ), and the Health (Age Limit for Specified Office) Order, 1957 ( S.I. No. 47 of 1957 ), shall be revoked as from the first day of July, 1960.

EXPLANATORY NOTE.

This declaration fixes age limits for pensionable offices under local authorities in relation to which the Minister for Health is the appropriate Minister for the purposes of Part II of the Local Government Act, 1941 . An age limit of seventy years is fixed for district medical officers and sixty-five years for other officers. For an officer who would not be entitled to a pension were he to retire at the fixed limit, the age limit is the age at which he becomes so entitled.

Under section 23 (2) of the Local Government Act, 1941 , Article 2 of this declaration will come into force on 1st July, 1960.
