ARBITRATION (FOREIGN AWARDS) ORDER, 1960

ARBITRATION (FOREIGN AWARDS) ORDER, 1960

WHEREAS a Convention on the Execution of Foreign Arbitral Awards (in this Order referred to as the Convention of 1927) was done at Geneva on the 26th day of September, 1927 :

AND WHEREAS the Instrument of Ratification of the Convention of 1927 was, on behalf of the State, deposited with the Secretary-General of the United Nations on the 10th day of June, 1957, and the Convention of 1927, in accordance with Article 8 thereof, took effect, in the case of the State, on the 10th day of September, 1957 :

AND WHEREAS it is enacted by paragraph (a) of subsection (1) of section 54 of the Arbitration Act, 1954 (No. 26 of 1954), that the Government, if satisfied that any State which has ratified the Convention of 1927 has made such reciprocal provisions as will enable the Convention of 1927 to be operative in any territory to which the Convention of 1927 is applicable, may by order declare--

(i) that State to be a party to the Convention of 1927,

(ii) that territory to be a territory to which the Convention of 1927 applies :

AND WHEREAS the Government are satisfied that these reciprocal provisions have been made by the States set out in column (1) of the Schedule to this Order and as respects the territories set out in column (2) of the said Schedule :

NOW, THEREFORE, the Government, in exercise of the powers conferred on them by paragraph (a) of subsection (1) of section 54 of the Arbitration Act, 1954 (No. 26 of 1954), hereby order as follows:--

1. This Order may be cited as the Arbitration (Foreign Awards) Order, 1960, and shall come into operation on the first day of February, 1960.

2. The States set out in column (1) of the Schedule to this Order are hereby declared to be parties to the Convention of 1927.

3. The territories set out in column (2) of the Schedule to this Order are hereby declared to be territories to which the Convention of 1927 applies.

EXPLANATORY NOTE

This Order, which is complementary to the Arbitration Act, 1954 (Section 12 (2) and Part V) (Commencement) Order, 1960 ( S.I. No. 14 of 1960 ), and which comes into operation on the 1st February, 1960, lists the States declared to be parties to the 1927 Geneva Convention on the Execution of Foreign Arbitral Awards and the territories declared to be territories to which that Convention applies. The effect of both Orders is to allow for the enforcement on a reciprocal basis in the State of foreign arbitral awards arising out of matters that may lawfully be referred to arbitration under Irish law.
