CONTROL OF IMPORTS (QUOTA NO. 51) (MISCELLANEOUS TEXTILES) ORDER, 1964.

CONTROL OF IMPORTS (QUOTA NO. 51) (MISCELLANEOUS TEXTILES) ORDER, 1964.

The Government, in exercise of the powers conferred on them by the Control of Imports Acts, 1934 to 1964, hereby order as follows:

1. This Order may be cited as the Control of Imports (Quota No. 51) (Miscellaneous Textiles) Order, 1964.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. (a) In this Order "the Act" means the Control of Imports (Amendment) Act, 1937 (No. 8 of 1937).

(b) A reference in this Order to a tariff heading number shall be construed as a reference to a tariff heading number in the Schedule to the Imposition of Duties (No. 128) (Customs Duties and Form of Customs Tariff) Order, 1962 ( S.I. No. 163 of 1962 ).

4. Subject to paragraphs 6 and 7 of this Order, the importation into the State on or after the 6th day of January, 1965, of the goods referred to in column (2) of the First Schedule to this Order is hereby prohibited.

5. The particulars stated in column (1) of the First Schedule to this Order in relation to a tariff heading number or tariff heading numbers mentioned in column (2) of that Schedule are inserted solely to facilitate reference to and identification of the goods specified at that tariff heading number or those tariff heading numbers, and accordingly nothing contained in the said column (1) shall affect the construction or limit or control the operation of this Order.

6. The prohibition on the importation of certain goods effected by paragraph 4 of this Order shall not extend or apply to--

(a) goods which are shown to the satisfaction of the Revenue Commissioners to have been manufactured in a country which is included in any group specified in the Second Schedule to this Order,

(b) goods which are imported under and in accordance with a licence in that behalf issued under section 14 of the Act, and authorising such importation notwithstanding the said prohibition,

(c) goods to which this Order is precluded from applying by section 4 of the Act,

(d) goods which are shown, to the satisfaction of the Revenue Commissioners, to be designed, constructed and intended solely for use for scientific, medical or surgical purposes,

(e) goods which are shown, to the satisfaction of the Revenue Commissioners, to be imported--

(i) solely for use as samples or models, or

(ii) for use exclusively in a stage play or other dramatic or musical representation or performance, or

(iii) for further manufacture and subsequent exportation or

(iv) solely for the purpose of any competition, exhibition, show or demonstration or any similar purpose and are not intended to be sold or offered for sale in the State, or

(v) temporarily only, or

(vi) by passengers as part of their personal effects in quantities which are reasonable having regard to the circumstances, or

(vii) as a gift from a person outside the State to a person resident in the State, or

(viii) for such purposes and in such circumstances that the importation thereof without payment of any duty of customs could lawfully be permitted by virtue of section 17 or of paragraph (a) or paragraph (b) or paragraph (h) of section 18 of the Finance Act 1936 (No. 31 of 1936), or of section 18 of the Finance Act, 1946 (No. 15 of 1946).

7. Section 7 of the Control of Imports Act, 1934 (No. 12 of 1934), shall not apply in relation to this Order.

8. The 1st day of February, 1965, is hereby appointed to be the day on which the first quota period under this Order shall commence.

Knitted or crocheted goods.

All goods specified at tariff heading numbers in Chapter 60, but excluding those specified at tariff heading numbers 60.01, 60.05(D)(2), 60.06(A) and 60.06(B).

Articles of apparel and clothing accessories of textile, other than knitted or crocheted.

Goods specified at tariff heading numbers 61.01 to 61.10 inclusive and 61.11(B).

Other made-up textiles--blankets, bed linen, towels etc., sacks and bags.

Goods specified at tariff heading numbers 62.01, 62.02(A),62.02(C), 62.02(D)(1), 62.02(D) (2) (a), 62.03, 62.04(A), 62.04(B) and 62.05, but excluding those specified at tariff heading numbers 62.05(F) and 62.05(R) (2).

Mattress supports and certain other articles of bedding or similar furnishing.

Goods specified at tariff heading numbers 94.04(A), 94.04(B)(2), 94.04(C) to 94.04(E) inclusive and 94.04(F)(1).

EXPLANATORY NOTE.

This Instrument prohibits the importation, save to the extent of an appointed quota, of certain classes of the following: textile yarns (other than woollen yarn); knitted or crocheted goods; articles of apparel and clothing accessories of textiles; other made-up textiles including blankets, bedlinen, towels, sacks and bags, mattress supports and certain other articles of bedding or similar furnishing, which have originated in the countries specifically listed at C of the Second Schedule to this Instrument.

Any importations effected under this Order will be subject also to the requirements of any existing Quota Order.
