I, ERSKINE H. CHILDERS, Minister for Transport and Power, in exercise of the powers conferred on me by section 8 of the Air Navigation and Transport Act, 1965 (No. 6 of 1965) and, in so far as the regulations relate to the prescription of fees, with the consent of the Minister for Finance, hereby make the following regulations :

1. These Regulations may be cited as the Air Navigation and Transport Act, 1965 (Section 8) Regulations, 1966.

2. These Regulations shall come into operation on the 1st day of June, 1966.

3. In these Regulations--

"the Act" means the Air Navigation and Transport Act, 1965 (No. 6 of 1965);

"Class A authorisation" means an authorisation under section 8 of the Act granted to an Irish citizen or a company registered in the State to operate an air service that consists of scheduled flights between places named in the authorisation and is not covered by a bilateral agreement or agreements between the State and the other State or States concerned;

"Class B authorisation" means an authorisation granted under section 8 of the Act to a person who is not an Irish citizen or a company that is not registered in the State to operate an air service that consists of scheduled flights between places named in the authorisation and is not covered by a bilateral agreement or agreements between the State and the other State or States concerned;

"Class C authorisation" means an authorisation granted under section 8 of the Act to an Irish citizen or a company registered in the State to operate a non-scheduled air service that does not include the provision of any inclusive tours;

"Class D authorisation" means an authorisation granted under section 8 of the Act to a person who is not an Irish citizen or a company that is not registered in the State to operate a non-scheduled air service that does not include the provision of any inclusive tours ;

"Class E authorisation" means an authorisation granted under section 8 of the Act to operate an inclusive tour or inclusive tours (other than inclusive tours on scheduled air services) between places named in the authorisation;

"Class F authorisation" means an authorisation granted under section 8 of the Act to make non-stop flights in transit over the territory of the State or to make landings at airports in the State for non-traffic purposes by aircraft in transit, being flights and landings not authorised under section 7 of the Act;

"inclusive tour" means a round trip which is performed in whole or in part by air for a comprehensive price and includes (at least) accommodation for the period the participants are away from the starting point of their journey.

4. An application for an authorisation under section 8 of the Act shall be addressed to the Secretary, Department of Transport and Power, Civil Aviation Division, Kildare Street, Dublin.

5. An application for a class A authorisation or a class C authorisation shall be in the form and contain the information set out in the First Schedule to these Regulations.

6. An application for a class B authorisation shall be made through the civil aviation authority of the country concerned.

7. An application for a class D authorisation shall be in the form and contain the information set out in the Second Schedule to these Regulations.

8. An application for a class E authorisation shall be in the form and contain the information set out in the Third Schedule to these Regulations and shall be made before the appropriate date specified in the said Third Schedule.

9. An application for a class F authorisation shall be in the form and contain the information set out in the Fourth Schedule to these Regulations.

10. A person who applies for or is the holder of an authorisation under section 8 of the Act may, if the Minister so directs, be required to satisfy the Minister that he is competent, as respects experience, financial resources, equipment, organisation, staffing, maintenance and operating procedures, to secure the safe operation of aircraft of the type in relation to which the authorisation relates or is sought, and, if the person fails to satisfy the Minister as aforesaid, the Minister may refuse to grant an authorisation under section 8 to the person or may revoke the authorisation, as may be appropriate.

11. (1) An officer of the Minister authorised in writing by the Minister for that purpose may (subject to the production by him if so required of his authorisation) at all reasonable times enter on and inspect aircraft and premises used or proposed to be used in connection with the operation of an air service to which an authorisation under section 8 of the Act relates or in relation to which such an authorisation is sought, as the case may be, and may there--

(a) remain on an aircraft about to commence a flight and enter and inspect the flight deck thereof during the flight,

(b) inspect any documents or records the inspection of which he may reasonably consider to be necessary for the purposes of the administration of these Regulations and make copies of or take extracts from the documents or records, and

(c) require any person to give him information which he may reasonably consider necessary for the purposes of the administration of these Regulations.

(2) A person--

(a) shall not obstruct or impede the exercise of any power conferred by this Regulation,

(b) shall give to an officer of the Minister authorised under this Regulation any information within his knowledge which the officer requires under this Regulation, and

(c) shall not, in giving any such information, give information which, to his knowledge, is false or misleading in any material particular.

12. The Minister may, if he so thinks fit, dispense with all or any of the requirements governing the furnishing of information in respect of applications for authorisations under section 8 of the Act.

13. The holder of an authorisation under section 8 of the Act, on being required at any time by an officer of the Minister or a member of the Garda Síochána, shall produce for inspection--

(a) the authorisation; and

(b) the journey log book or other record kept pursuant to Article 17 of the Air Navigation (Operations) Order, 1964 ( S.I. No. 140 of 1964 ), and the insurance policies in respect of the aircraft to which the authorisation relates.

14. If an authorisation under section 8 of the Act is revoked by the Minister, the holder shall upon receipt by him of a notice of the revocation forthwith deliver up the authorisation to the Minister.

15. The holder of an authorisation under section 8 of the Act shall have and maintain in force in respect of each aircraft specified in the authorisation such insurance as the Minister considers adequate against such categories of risks as the Minister may specify and, if so requested, shall produce to the Minister for inspection the relevant insurance policy or insurance certificate.

16. The fees specified at a reference number in the Fifth Schedule to these Regulations are hereby prescribed in respect of the authorisations mentioned at that reference number.

17. (1) The fees specified in the Fifth Schedule to these Regulations shall be payable to the Minister as therein provided in respect of authorisations specified in the Schedule.

(2) The Public Offices (Fees) Act, 1879, shall not apply in respect of such fees.

Note : Fees are payable as follows:--

For Class A Authorisation £10 on application and £10 per annum thereafter for as long as the authorisation is valid.

For Class C Authorisation £5 on application and £5 per annum thereafter for as long as the authorisation is valid.

Any person who is already the holder of a valid Class A Authorisation shall not be required to pay any fee on application for an additional Class A Authorisation; the fees payable by that person thereafter shall be a total of £10 per annum in respect of all Class A Authorisations held by him for as long as any of the authorisations is valid.

Any person who is already the holder of a valid Class C Authorisation shall not be required to pay any fee on application for an additional Class C Authorisation; the fees payable by that person thereafter shall be a total of £5 per annum in respect of all Class C Authorisations held by him for as long as any of the authorisations is valid.

Note: Application should be made by the operator of the proposed service.

3. Applications should be accompanied by--

(a) Confirmation by Insurance Company that the flights are covered for passenger liability up to the limits of the Hague Protocol of 1955 to the International Convention for the Unification of Certain Rules relating to the International Carriage by Air done at Warsaw on 12th October, 1929, and for liability to third parties on the surface, to an extent considered adequate by the Minister having regard to the operations to be performed,

(b) Confirmation that before entering into the contract of carriage the passengers will be informed of the type of aircraft (and alternative) to be provided, the name of the operating carrier and the airport at which the passengers will be set-down.
