FISH (REGULATION OF IMPORT) ORDER, 1966.

FISH (REGULATION OF IMPORT) ORDER, 1966.

I, CHARLES J. HAUGHEY, Minister for Agriculture and Fisheries, in exercises of the powers conferred on me by section 2 of the Agricultural Products (Regulation of Import) Act, 1938 (No. 14 of 1938), as adapted by the Agriculture (Alteration of Name of Department and Title of Minister) Order, 1965 ( S.I. No. 146 of 1965 ), hereby, after consultation with the Minister for Finance and the Minister for Industry and Commerce, order as follows:

1. (1) This Order may be cited as the Fish (Regulation of Import) Order, 1966.

(2) This Order shall come into operation on the 1st day of July, 1966.

2. In this Order--

" fish " means fish which are fresh (whether live or dead), chilled or frozen, and includes filleted fish and parts of fish but does not include shellfish;

" the Minister " means the Minister for Agriculture and Fisheries;

" the United Kingdom " means Great Britain, Northern Ireland, the Isle of Man and the Channel Islands.

3. It shall not be lawful to import fish unless--

(a) such fish have been taken by, and are landed in the State from, an Irish sea-fishing boat within the meaning of Part XIII of the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959), or

(b) such fish consist solely of herrings or mackerel or both herrings and mackerel which either originated in and are consigned from the United Kingdom, or have been taken by, and are landed in the State from, a fishing boat registered as such in the United Kingdom under legislation then in force there and relating to merchant shipping, or

(c) such fish consist of dead fish unfit for human consumption or fish waste which (in either case) originated in and are consigned from the United Kingdom, or

(d) (i) there is delivered to the proper officer of Customs and Excise at the time of importation a licence under this Order,

(ii) the quantity of fish imported does not exceed the quantity permitted to be imported by the licence, and

(iii) the conditions attached to the licence have been complied with.

4. (1) The Minister may, whenever and so often as he thinks fit, issue a licence under this Order to import a specified quantity of fish.

(2) Whenever the Minister issues a licence under this Order, he may attach to the licence one or more of the following conditions :

(a) a condition that the fish shall be of a specified description ;

(b) a condition that the fish shall be imported within a specified time or during a specified period ;

(c) a condition that the fish shall be imported from a specified country ;

(d) a condition that the fish shall be imported at a specified port or place or by a specified route ;

(e) a condition that the fish shall not be imported in more than a specified number of consignments ;

(f) a condition that the fish shall be imported by or on behalf of a specified person ;

(g) a condition that the fish shall be disposed of in a specified manner, for a specified purpose, or both in a specified manner and for a specified purpose.

(3) The Minister may at any time revoke any licence under this Order.

5. A person who imports or attempts to import fish in contravention of this Order, or who aids or abets the importation or attempted importation of fish in contravention of this Order, shall be guilty of an offence under this Order and shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds.

6. The Fish (Regulation of Import) (No. 2) Order, 1938 (No. 266 of 1938), is hereby revoked.

EXPLANTORY NOTE.

This Order prohibits as from 1st July, 1966, the importation save under licence, of fresh, chilled or frozen fish, with certain specified exceptions. This Order does not apply to shellfish.
