GARDA Síochána PENSIONS ORDER, 1972.

I, DESMOND O'MALLEY, Minister for Justice, in exercise of the powers conferred on me by section 13 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), with the sanction of the Minister for Finance and after due compliance with subsection (2) of the said section 13, hereby order as follows :

1. (1) This Order may be cited as the Garda Síochána Pensions Order, 1972.

(2) This Order and the Garda Síochána Pensions Orders, 1925 to 1969, may be cited together as the Garda Síochána Pensions Orders, 1925 to 1972.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In this Order

" the Order of 1925 " means the Garda Síochána Pensions Order, 1925 ( S. R. & O. No. 63 of 1925 ) ;

" the Order of 1951 " means the Garda Síochána Pensions Order, 1951 ( S.I. No. 410 of 1951 ).

4. (1) A person who--

(i) was serving as a member of the Garda Síochána on the 15th day of January, 1970, and

(ii) was not pensionable in accordance with the Order of 1951,

shall be deemed to be so pensionable with effect from the 15th day of January, 1970, unless, within three months after the making of this Order, he notifies the Minister in writing that he does not wish to become so pensionable.

(2) Any amount of pension which has been overpaid to a person to whom paragraph (1) of this Article applies shall be recovered by deducting that amount from any gratuity which is payable in respect of that person's service in the Force by reason of the operation of the said paragraph (1).

EXPLANATORY NOTE.

This order provides that members serving on 15th January, 1970 who did not previously opt for the provisions of the Garda Síochána Pensions Order, 1951 will become pensionable in accordance with the terms of that Order unless they express a wish to the contrary.
