FACTORIES ACT, 1955 (APPLICATION OF SECTION 76 TO CERTAIN DISEASES) REGULATIONS, 1972.

I, JOSEPH BRENNAN, Minister for Labour, in exercise of the powers conferred on me by sections 6 and 76 (6) of the Factories Act, 1955 (No. 10 of 1955), and the Labour (Transfer of Departmental Administration and Ministerial Functions) Order, 1966 ( S.I. No. 164 of 1966 ), after consultation with the Minister for Health, hereby make the following regulations :

1. (1) These Regulations may be cited as the Factories Act, 1955 (Application of Section 76 to Certain Diseases) Regulations, 1972.

(2) These Regulations shall come into operation on the 1st day of January, 1973.

2. These Regulations shall apply to all factories.

3. Section 76 of the Factories Act, 1955 (No. 10 of 1955), is hereby applied to the diseases specified in the Schedule to these Regulations.

4. The Factories Act, 1955 (Application of Section 76 to Certain Diseases) Regulations, 1956 ( S.I. No. 170 of 1956 ) are hereby revoked.

SCHEDULE.

1. Acute, sub-acute or chronic disease of any organ due to any of the undermentioned metallic elements, their compounds or alloys--

(a) beryllium,

(b) cadmium,

(c) manganese.

2. Acute, sub-acute or chronic disease of any organ due to any organic compound of any of the following--

(a) arsenic,

(b) lead,

(c) mercury.

3. Acute, sub-acute or chronic disease of any organ due to triphenyl phosphate, tricresyl phosphate or to the anti-cholinesterase action of any organic phosphorus compound.

4. Acute, sub-acute or chronic disease of any organ due to poisoning by--

(a) a nitro or amino derivative of benene or chlorobenzene,

(b) a homologue of benzene or chlorobenzene,

(c) carbon bisulphide.

5. Chronic benzene poisoning or any blood abnormality caused by or contributed to by present or past exposure to benzene.

6. Toxic jaundice due to tetrachlorethane or a nitro or amino derivative of benzene or other poisonous substances.

7. Epitheliomatous ulceration due to tar, pitch, bitumen, mineral oil or paraffin, or any compound, product or residue of any of these substances.

8. Chrome ulceration due to chromic acid or bichromate of potassium, sodium or ammonium or any preparation of these substances.

9. Compressed air illness.

10. Toxic anaemia.

EXPLANATORY NOTE.

These regulations prescribe industrial diseases additional to those specified in section 76 of the Act, which must be notified to the Minister.
