S.I. No. 141/1977:

COURTS (SUPPLEMENTAL PROVISIONS) ACT, 1961 (SECTION 46) ORDER, 1977.

COURTS (SUPPLEMENTAL PROVISIONS) ACT, 1961 (SECTION 46) ORDER, 1977.

The Government, in exercise of the powers conferred on them by section 46 of the Courts (Supplemental Provisions) Act, 1961 (No. 39 of 1961), as amended by section 1 of the Courts (Supplemental Provisions) (Amendment) (No. 2) Act, 1968 (No. 21 of 1968), hereby make the following order with respect to which, pursuant to the said section 46 as amended as aforesaid, a draft has been laid before Dáil Éireann and a Resolution disapproving of the draft has not been passed by Dáil Éireann within the next subsequent twenty-one days on which it has sat after the draft was laid before it:

1. This Order may be cited as the Courts (Supplemental Provisions) Act, 1961 (Section 46) Order, 1977.

2. In this Order--

"the Agreement of 1972" means the National Agreement, 1972, of the Employer-Labour Conference ratified on the 31st day of July, 1972;

"the Agreement of 1974" means the Employer-Trade Union National Agreement, 1974, of the Employer-Labour Conference ratified on the 7th day of March, 1974;

"the Agreement of 1975" means the Employer-Trade Union National Agreement, 1975, of the Employer-Labour Conference ratified on the 22nd day of April, 1975, and revised on the 24th day of September, 1975;

"the Agreement of 1976" means the Employer-Trade Union Interim National Agreement, 1976, of the Employer-Labour Conference ratified on the 16th day of September, 1976;

"the Agreement of 1977" means the Employer-Trade Union National Agreement, 1977, of the Employer-Labour Conference ratified on the 23rd day of February, 1977.

3. The sums payable by way of remuneration to the several judges of the Supreme Court, the High Court and the Circuit Court and the several justices of the District Court shall be and be deemed to have been increased--

(a) with effect from the 1st day of January, 1977--

(i) by an amount calculated in accordance with Clause 3 (f) of the Agreement of 1975,

(ii) by an amount calculated in accordance with Clause 3 (b) of the Agreement of 1972, as applied by Clause 3 (f) of the Agreement of 1974 and Clause 3 (d) of the Agreement of 1976, and

(iii) by an amount calculated in accordance with Clause 3 (b) of the Agreement of 1976,

(b) with effect from the 1st day of April, 1977, by an amount calculated in accordance with Clause 3 (c) of the Agreement of 1977, and

(c) with effect from the 1st day of November, 1977, by an amount calculated in accordance with Clause 3 (d) of the Agreement of 1977.

EXPLANATORY NOTE.

This order gives to the members of the judiciary the increases due under the National Agreements during 1976 and 1977. However, the increases due during 1976 are only being paid with effect from 1 January, 1977.
