BRUCELLOSIS IN CATTLE (MOVEMENT CONTROL) ORDER, 1978.

I, JAMES GIBBONS, Minister for Agriculture, in exercise of the powers conferred on me by sections 3 and 20 of the Diseases of Animals Act, 1966 (No. 6 of 1966), as adapted by the Agriculture and Fisheries (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 31 of 1977 ), hereby order as follows:

1. (1) This Order may be cited as the Brucellosis in Cattle (Movement Control) Order, 1978.

(2) This Order shall come into operation on the 18th day of September, 1978.

2. (1) In this Order--

"animal" means a bovine animal;

"the area" means the area comprised of the administrative counties of Cavan, Clare, Donegal, Dublin, Galway, Kerry, Leitrim, Longford, Louth, Mayo, Meath, Monaghan Roscommon, Sligo, Westmeath, together with that part of the administrative county of Limerick lying North of the River Shannon, that part of the county borough of Limerick lying North of the River Shannon and that part of the administrative county of Offaly lying North and West of the River Brosna;

"authorised officer" means an officer of the Minister appointed by the Minister in writing to be an authorised officer for the purposes of the Orders made under the Diseases of Animals Act, 1966 (No. 6 of 1966), for the purpose of the progressive eradication of brucellosis in cattle;

"eligible animal" means any female animal aged twelve months or any male animal aged nine months or over, except a castrate;

"herd" includes a herd consisting of one animal only;

"the Minister" means the Minister for Agriculture;

"test" means a test for brucellosis.

(2) A holding situate partly in the area shall, for the purposes of this Order, be deemed to be wholly within that area.

(3) A reference in this Order to any other statutory instrument is to that instrument as amended by any other statutory instrument.

3. (1) A person shall not move an eligible animal into or out of a herd in the area otherwise than for slaughter unless--

( a ) he has in his possession a cattle identity card issued by the Minister and relating to the animal, and

( b ) the animal has passed a test, and

( c ) the date of the test, as specified in such card, is a day not more than thirty days prior to the day on which the animal is so moved.

(2) A person shall not move into the area, or into a herd in the area, otherwise than for slaughter, an eligible animal which has come from a herd in Northern Ireland unless--

( a ) the person in charge of the animal has in his possession a permit issued by the Ministry of Agriculture in Northern Ireland and authorising the movement of the animal, and

( b ) the animal has passed a test, and

( c ) the date of the test, as specified in the permit, is a day not more than thirty days prior to the day on which the animal is moved.

4. An eligible animal shall not be exposed at a public show or sale of cattle in the area unless--

( a ) the person in charge of the animal has in his possession a cattle identity card issued by the Minister and relating to the animal, and

( b ) the animal has passed a test, and

( c ) the date of the test, as specified in the card, is a day not more than thirty days prior to the day on which the animal is so exposed.

5. An authorised officer may, in relation to cattle in the area, cattle being moved into the area or into or out of herds in the area or cattle being exposed at any public show or sale of cattle in the area, make such inquiries as may be reasonably necessary for the administration of this Order.

6. When an inspector of the Minister or an authorised officer makes a demand or inquiry pursuant to this Order he shall, if requested, produce his appointment for examination by the person concerned.

7. The provisions of this Order are in addition to, and not in substitution for, the provisions of the following, namely:

( a ) the Brucellosis in Cattle (Clearance Area) (General Provisions) Order, 1966 ( S.I. No. 120 of 1966 ),

( b ) the Brucellosis in Cattle (Disease-Free Area) Order, 1968 ( S.I. No. 112 of 1968 ),

( c ) the Brucellosis in Cattle (Movement Control) Order, 1970 ( S.I. No. 135 of 1970 ),

( d ) the Brucellosis in Cattle (Movement Control) (Supplementary Provisions) Order, 1971 ( S.I. No. 176 of 1971 ), and

( e ) the Brucellosis in Cattle (Movement Control) Order, 1973 ( S.I. No. 132 of 1973 ).

EXPLANATORY NOTE.

This Order controls the movement including the exposure for public sale of certain classes of animals within counties, Cavan, Clare, Dublin, Donegal, Galway, Kerry, Leitrim, Longford, Loath, Mayo, Meath, Monaghan, Roscommon, Sligo, Westmeath, that part of the administrative county of Limerick lying north of the river Shannon, that part of the county borough of Limerick lying north of the river Shannon and that part of the administrative county of Offaly lying north and west of the river Brosna.
